Coming into force

The Welsh Ministers, in exercise of the powers conferred by section 56(1) and (2) of the Finance Act 19731 and now vested in them by section 59(5) of the Government of Wales Act 20062, and paragraph 1A of Schedule 2 to the European Communities Act 19723, and with the consent of the Treasury, make the following Regulations.

Title, application and commencement1

The title of these Regulations is the Zoonoses and Animal By-Products (Fees) (Wales) (Amendment) Regulations 2008, they apply in relation to Wales and come into force on 1 January 2009.

Amendments2

The Zoonoses and Animal By-Products (Fees) (Wales) Regulations 20084 are amended as follows.

After regulation 3, paragraph 1(f), insert—

g

conducting tests under point 4(b)(i) of Part D of Annex II to the European Regulation;

h

conducting tests under point 4(b)(ii) of Part D of Annex II to the European Regulation;

i

conducting tests under point 4(b)(iii) of Part D Annex II to the European Regulation5.

After regulation 3, paragraph 2(b), insert—

c

the person in charge of a holding where testing is carried out in respect of the activities in paragraphs (1)(g), (1)(h) and (1)(i).

These Regulations apply in relation to Wales and make provision for the Welsh Ministers to charge fees for conducting tests that farmers may request under Commission Regulation (EC) No 1237/2007 (OJ No L280, 24.10.2007, p.5). These Regulations amend the Zoonoses and Animal By-Products (Fees) (Wales) Regulations 2008.

A Regulatory Impact Assessment of the effect of these Regulations has been prepared and is annexed to the Explanatory Memorandum. Copies may be obtained from the Welsh Assembly Government, Cathays Park, Cardiff, CF10 3NQ.
