Gwahardd brechu

29.  Mae'n dramgwydd brechu mochyn yn erbyn clefyd pothellog y moch ac eithrio—

(a)yn unol â rheoliad 30, neu

(b)o dan awdurdod trwydded a roddwyd gan Weinidogion Cymru.

Brechu gorfodol

30.—(1) Caiff Gweinidogion Cymru ddatgan parth brechu lle bydd yn rhaid i bob meddiannydd mangre yn y parth sy'n cynnwys mochyn sicrhau bod moch ar y fangre honno'n cael eu brechu'n unol â'r datganiad hwnnw.

(2) Bydd meddiannydd o'r fath sy'n methu â brechu mochyn yn unol â'r datganiad yn cyflawni tramgwydd.

(3) Caiff mangre sy'n rhannol y tu mewn ac yn rhannol y tu allan i barth brechu ei thrin fel petai y tu mewn i'r parth.

(4) Yn achos moch sydd y tu allan i barth brechu, neu os nad yw parth brechu wedi'i ddatgan, caiff arolygydd milfeddygol gyflwyno hysbysiad i feddiannydd mangre sy'n cynnwys mochyn yn ei gwneud yn ofynnol i'r meddiannydd hwnnw sicrhau bod pob mochyn sydd ar y fangre'n cael ei frechu yn unol â'r hysbysiad hwnnw, a bydd methu â chydymffurfio â'r hysbysiad yn dramgwydd.

Moch a frechwyd

31.—(1) Rhaid i berchennog mochyn sydd wedi'i frechu yn erbyn clefyd pothellog y moch sicrhau bod y mochyn wedi'i nodi'n un sydd wedi'i frechu felly.

(2) Os oedd y brechu'n ganlyniad i ddatgan parth brechu, ni chaiff neb symud mochyn sydd wedi'i frechu y tu allan i'r parth ac eithrio i ladd-dy a ddynodwyd at y diben gan Weinidogion Cymru lle bydd yn rhaid iddo gael ei gadw a'i gigydda ar wahân i foch sydd heb eu brechu.

(3) Fel arall ni chaiff neb symud mochyn sydd wedi'i frechu o'r fangre lle cafodd ei frechu (neu, os oedd y drwydded yn caniatáu brechu mewn ardal, o'r ardal lle mae brechu wedi'i ganiatáu) ac eithrio i ladd-dy a ddynodwyd at y diben gan Weinidogion Cymru lle bydd yn rhaid iddo gael ei gadw a'i gigydda ar wahân i foch sydd heb eu brechu.

(4) Mae methu â chydymffurfio â'r rheoliad hwn yn dramgwydd.
