Deiliadaeth swydd ac atal deiliadaeth swydd cyfarwyddwyr gweithredol

9.—(1) Yn ddarostyngedig i reoliad 8(2), bydd cyfarwyddwr gweithredol i'r Ymddiriedolaeth yn ddeiliad swydd—

(a)os nad y cyfarwyddwr hwnnw yw'r prif swyddog neu'r prif swyddog cyllid, cyhyd ag y bydd yn ddeiliad swydd yn yr Ymddiriedolaeth;

(b)os y prif swyddog neu'r prif swyddog cyllid yw'r cyfarwyddwr hwnnw, cyhyd ag y bydd yn ddeiliad y swydd honno yn yr Ymddiriedolaeth.

(2) Os bydd y pwyllgor perthnasol o'r farn nad yw'n llesol i fuddiannau'r Ymddiriedolaeth fod cyfarwyddwr gweithredol i'r Ymddiriedolaeth ac eithrio'r prif swyddog neu'r prif swyddog cyllid yn parhau i fod yn ddeiliad swydd cyfarwyddwr bydd y pwyllgor perthnasol yn terfynu ei ddeiliadaeth swydd ar unwaith.

(3) Os bydd cyfarwyddwr gweithredol i'r Ymddiriedolaeth yn cael ei atal o'i swydd yn yr Ymddiriedolaeth bydd y cyfarwyddwr hwnnw'n cael ei atal rhag cyflawni ei swyddogaethau cyfarwyddwr am y cyfnod y bydd wedi ei atal.

(4) Caiff cyfarwyddwr gweithredol ac eithrio prif swyddog neu brif swyddog cyllid yr Ymddiriedolaeth ymddiswyddo o'i swydd ar unrhyw adeg yn ystod y cyfnod y cafodd ei benodi i'w weithio drwy gyflwyno hysbysiad ysgrifenedig i'r pwyllgor perthnasol.
