Cymhwyso darpariaethau amrywiol Deddf Diogelwch Bwyd 1990LL+C
11.—(1) Mae darpariaethau canlynol y Ddeddf yn gymwys at ddibenion y Rheoliadau hyn gyda'r addasiad bod unrhyw gyfeiriad yn y darpariaethau hynny at y Ddeddf i'w ddehongli fel cyfeiriad at y Rheoliadau hyn—
(a)adran (ystyr estynedig “sale” etc.);
(b)adran 3 (rhagdybiad bod bwyd wedi'i fwriadu ibobl ei fwyta);
(c)adran 20 (tramgwyddau oherwydd bai person arall);
(ch)adran 21 (amddiffyniad diwydrwydd dyladwy), gyda'r addasiad y bydd is-adrannau (2) i (4) yn gymwys o ran tramgwydd o fynd yn groes i reoliad 4, 5, 6, 7, neu 8 o'r Rheoliadau hyn fel y bônt yn gymwys mewn perthynas â thramgwydd o dan adran 14 neu 15;
(d)adran 30(8) (sy'n ymwneud â thystiolaeth ddogfennol);
(dd)adran 33(1) (rhwystro etc. swyddogion);
(e)adran 35(1) (cosbi tramgwyddau) i'r graddau y mae'n ymwneud â thramgwyddau o dan adran 33(1) fel y'i cymhwysir gan is-baragraff (dd);
(f)adran 36 (tramgwyddau gan gyrff corfforaethol);
(ff)adran 36A (tramgwyddau gan bartneriaethau Albanaidd)(1);
(g)adran 44 (amddiffyn swyddogion sy'n gweithredu'n ddidwyll);
(ng)adran 58(1) (sy'n ymwneud â dyfroedd tiriogaethol).
(2) Mae adran 9 (arolygu bwyd dan amheuaeth ac ymafael ynddo) o'r Ddeddf yn gymwys at ddibenion y Rheoliadau hyn fel pe bai bwyd yr oedd yn dramgwydd i'w werthu oddi tanynt yn fwyd a fethodd â chydymffurfio â gofynion diogelwch bwyd.
(3) Mae adran 34 (sy'n ymwneud â therfynau amser ar gyfer dechrau erlyniadau) o'r Ddeddf yn gymwys mewn perthynas â thramgwyddau o dan y Rheoliadau hyn yn yr un modd ag y mae'n gymwys i dramgwyddau y gellir eu cosbi o dan adran 35(2) o'r Ddeddf.
