Penderfyniad yr awdurdod arweiniol

10.—(1) Yn ddarostyngedig i baragraff (2), o fewn cyfnod o 28 diwrnod sy'n cychwyn gyda'r diwrnod y ceir gwrthwynebiad neu, yn ôl fel y digwydd, ddiwrnod olaf y cyfnod y mae'n rhaid cyflwyno'r cyfryw wybodaeth bellach neu dystiolaeth ynddo o dan reoliad 9, rhaid i'r awdurdod arweiniol benderfynu—

(a)a yw'r gwrthwynebydd yn weithredwr perthnasol; a

(b)a yw'r gwrthwynebiad yn wrthwynebiad derbyniadwy;

a dyroddi hysbysiad ysgrifenedig i hysbysu'r gwrthwynebydd o'r penderfyniad hwnnw.

(2) Caiff yr awdurdod arweiniol, gyda chaniatâd ysgrifenedig y gwrthwynebydd, estyn y cyfnod o 28 diwrnod a bennir ym mharagraff (1).

(3) Os yw'r awdurdod arweiniol yn penderfynu—

(a)bod y gwrthwynebydd yn weithredwr perthnasol, a

(b)bod y gwrthwynebiad yn wrthwynebiad derbyniadwy,

rhaid i'r hysbysiad ysgrifenedig a ddyroddir yn unol â pharagraff (1) fodloni'r gofyniad a ddisgrifir ym mharagraff (4).

(4) Y gofyniad yw fod rhaid i'r hysbysiad ysgrifenedig naill ai—

(a)disgrifio'r addasiadau y mae'r awdurdod arweiniol yn bwriadu eu gwneud yn y safon gwasanaethau a bennir yn y cynllun, o ganlyniad i'r penderfyniad; neu

(b)disgrifio pa bryd ac ym mha fodd y bydd yr awdurdod arweiniol yn dyroddi hysbysiad atodol i hysbysu'r gwrthwynebydd o'r addasiadau arfaethedig.

(5) Rhaid i'r awdurdod arweiniol anfon copi o'r hysbysiad ysgrifenedig a ddyroddir yn unol â pharagraff (1), a phan fo'n briodol yr hysbysiad atodol a ddyroddir yn unol â pharagraff (4)(b) at y comisiynydd traffig.
