Pŵer wneud cais am wybodaeth sy'n ymwneud â chamau gorfodi
8.—(1) Er mwyn cyflawni ei swyddogaeth o dan reoliad 7 mewn perthynas ag unrhyw awdurdod gorfodi caiff yr Asiantaeth ei gwneud yn ofynnol i berson a grybwyllir ym mharagraff (2)—
(a)darparu i'r Asiantaeth unrhyw wybodaeth y mae ganddi achos rhesymol dros gredu bod y person hwnnw'n gallu ei rhoi; neu
(b)trefnu bod unrhyw gofnodion y mae gan yr Asiantaeth achos rhesymol dros gredu eu bod gan y person hwnnw neu eu bod fel arall o dan reolaeth y person hwnnw ar gael i'r Asiantaeth i'w harchwilio ganddi (ac, os ydynt yn cael eu cadw ar ffurf gyfrifiadurol, trefnu eu bod ar gael ar ffurf ddarllenadwy).
(2) Caniateir i ofyniad o dan baragraff (1) gael ei osod—
(a)ar yr awdurdod gorfodi neu unrhyw aelod, swyddog neu gyflogai i'r awdurdod; neu
(b)ar berson sy'n dod o dan unrhyw ddyletswydd o dan ddeddfwriaeth archwilio berthnasol (sef dyletswydd sy'n orfodadwy gan awdurdod gorfodi) neu unrhyw swyddog neu gyflogai i berson o'r fath.
(3) Caiff yr Asiantaeth gopïo unrhyw gofnodion y trefnir eu bod ar gael iddi yn unol â gofyniad o dan baragraff (1)(b).
