Esemptiad rhag difrod i ddŵr
9.—(1) Nid yw difrod i ddŵr yn cynnwys—
(a)difrod a achosir gan addasiadau newydd i nodweddion ffisegol crynofa dŵr wyneb,
(b)newid i lefel crynofa dŵr daear yn unol â Chyfarwyddeb 2000/60/EC Senedd Ewrop a'r Cyngor, neu
(c)dirywio o statws uchel i statws da crynofa dŵr wyneb sy'n ganlyniad i weithgareddau newydd o ran datblygiadau dynol cynaliadwy yn unol â'r Gyfarwyddeb honno,
os caiff pob amod ym mharagraff (2) ei gyflawni.
(2) Yr amodau yw—
(a)bod pob cam ymarferol yn cael ei gymryd i leddfu ar yr effaith andwyol ar statws y grynofa ddŵr;
(b)bod y rhesymau dros yr addasiadau neu'r newidiadau wedi'u gosod a'u hesbonio yn benodol yn y cynllun rheoli basn afon sy'n ofynnol o dan Erthygl 13 o Gyfarwyddeb 2000/60/EC Senedd Ewrop a'r Cyngor a bod yr amcanion yn cael eu hadolygu bob chwe mlynedd;
(c)bod y rhesymau dros yr addasiadau neu'r newidiadau o ddiddordeb cyhoeddus hollbwysig, neu fod manteision yr addasiadau newydd neu'r newidiadau newydd i iechyd dynol, i waith cadw pobl yn ddiogel neu i ddatblygu cynaliadwy yn drech na chanlyniad y difrod; ac
(ch)nad oes modd i'r amcanion buddiol, y mae'r addasiadau neu'r newidiadau hynny i'r grynofa ddŵr yn gyfrwng i'w cyflawni, gael eu sicrhau drwy ddulliau eraill oherwydd dichonolrwydd technegol neu gostau anghymesur.
