Nodyn Esboniadol

Mae'r Gorchymyn hwn yn dwyn Rhan 3 o Fesur Plant a Theuluoedd (Cymru) 2010 (“y Mesur”) i effaith ar 1 Medi 2010 yn yr ardaloedd penodedig. Yr ardaloedd penodedig yw ardaloedd awdurdodau lleol Merthyr Tudful, Casnewydd, Rhondda Cynon Taf a Wrecsam.
Mae Rhan 3 o'r Mesur yn gwneud yn ofynnol bod awdurdodau lleol sefydlu un neu ragor o dimau integredig cymorth i deuluoedd (“ICiD”) yn eu hardal. Rhaid i Fwrdd Iechyd Leol y mae ei ardal yn cyfateb i ardal awdurdod lleol gymryd rhan mewn sefydlu'r tîm. Mae adran 58 o'r Mesur yn nodi'r mathau o achosion y gellir eu hatgyfeirio at dîm integredig cymorth i deuluoedd ac y mae adran 58(6) yn pennu'r categorïau o oedolion a all fod yn ddarostyngedig i atgyfeiriad teuluol. Paragraff (a) yn unig o adran 58(6) a gychwynnir. Hynny yw, ni chaiff tîm ICiD dderbyn atgyfeiriadau mewn perthynas â theulu ac eithrio pan fo rhiant yn ddibynnol ar alcohol neu gyffuriau.
Mae Rhan 3 yn cynnwys darpariaeth arall ynglŷn â chyllido timau ICiD (a.59) a chyfansoddiad y timau ICiD (a. 60). Mae adrannau 61 a 62 yn darparu am sefydlu byrddau ICiD i oruchwylio'r timau. Mae adran 63 yn rhoi pŵer i Weinidogion Cymru i wneud rheoliadau am amrywiol agweddau o weithrediad y timau a'r byrddau ICiD. Mae adran 64 yn gwneud yn ofynnol bod bwrdd yn paratoi adroddiad blynyddol ar y tîm. Mae adran 65 yn gwneud yn ofynnol bod awdurdodau lleol, byrddau iechyd lleol, a thimau a byrddau ICiD yn rhoi roi sylw i unrhyw ganllawiau a roddir gan Weinidogion Cymru.
