Changes to Legislation
Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. Ar hyn o bryd mae unrhyw newidiadau neu effeithiau hysbys a wnaed gan ddeddfwriaeth ddilynol wedi'u gwneud i destun y ddeddfwriaeth yr ydych yn edrych arni gan y tîm golygyddol. 20.—(1) Rhaid i berson cofrestredig weithredu fel gwarchodwr plant neu ddarparu gofal dydd, yn ôl fel y digwydd, mewn ffordd sy'n—
(a)hyrwyddo ac yn darparu'n briodol ar gyfer lles plant perthnasol; a
(b)yn darparu'n briodol ar gyfer gofal, addysg , goruchwyliaeth, a phan fo'n briodol, triniaeth i blant perthnasol.
(2) Rhaid i'r person cofrestredig sicrhau bod pob person sydd wedi cyrraedd 16 mlwydd oed ac—
(a)yn byw yn y fangre berthnasol;
(b)yn gweithio yn y fangre berthnasol (ac eithrio person a grybwyllir yn rheoliad 28); neu
(c)sydd fel arall yn bresennol yn y fangre berthnasol ac yn dod, neu'n debygol o ddod, i gysylltiad yn rheolaidd â phlant perthnasol,
[F1yn addas i gael cyswllt â phlant].
(3) At ddibenion paragraff (2), mae person sy'n gweithio yn y fangre berthnasol yn cynnwys person sy'n gweithio ar sail wirfoddol.
(4) Rhaid i'r person cofrestredig gadarnhau wrth Weinidogion Cymru, mewn perthynas â phob person a grybwyllir ym mharagraff (2)—
(a)[F2pan fo’n briodol,] bod tystysgrif cofnod troseddol fanylach wedi ei dyroddi; a
(b)pan fo'n briodol(1), y person wedi ei gofrestru gydag ADA ac wedi darparu ei rif cofrestru ADA i'r person cofrestredig.
(5) Os nad oes hawl gan y person cofrestredig i gael, mewn perthynas â pherson y cyfeirir ato ym mharagraff (2), yr wybodaeth neu'r ddogfennaeth y gellir seilio'r cadarnhad sy'n ofynnol gan baragraff (4) arni, rhaid i'r person cofrestredig sicrhau bod unrhyw berson o'r fath yn cael ei oruchwylio'n briodol ar bob achlysur pan fo mewn cysylltiad â phlentyn neu blant perthnasol.
(6) Rhaid i'r person cofrestredig, at y diben o ddarparu gofal i blant perthnasol a gwneud darpariaeth briodol ar gyfer eu lles ac i'r graddau y bo'n ymarferol, ganfod a chymryd i ystyriaeth eu dymuniadau a'u teimladau.
(7) Rhaid i'r person cofrestredig wneud trefniadau addas i sicrhau, tra bo plant perthnasol yng ngofal y person cofrestredig—
(a)bod eu preifatrwydd a'u hurddas yn cael eu parchu;
(b)y rhoddir sylw dyladwy i'w rhyw, argyhoeddiad crefyddol, tarddiad hiliol a chefndir diwylliannol ac ieithyddol ac unrhyw anabledd sy'n effeithio arnynt.

Mae'r gofyniad ar i bersonau sy'n ymgymryd â gweithgarwch a reoleiddir mewn lleoliadau gofal plant gofrestru gydag ADA o dan y Cynllun Fetio a Gwahardd yn cael ei weithredu fesul cam, yn unol â Rheoliadau a wnaed o dan Ddeddf Diogelu Grwpiau Hyglwyf 2006 (p.47). Mewn perthynas â hyn, rhaid dehongli'r ymadrodd “pan fo'n briodol” yn unol â'r gofyniad sydd ar y person i gofrestru gydag ADA, fel a esbonnir yn y Vetting and Barring Scheme Guidance (ISBN - 978 - 1 - 84987 - 2020 7) a gyhoeddwyd gan y Swyddfa Gartref ym Mawrth 2010.
