The Animals (Divisional Veterinary Managers) (Wales) Regulations 2010

The Welsh Ministers are designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Community and, in exercise of the powers conferred by that section, make the following Regulations:

Title and commencement

1.  The title of these Regulations is the Animals (Divisional Veterinary Managers) (Wales) Regulations 2010; they apply in relation to Wales and come into force on 1 April 2010.

Amendments to the Products of Animal Origin (Import and Export) Regulations 1996

2.—(1) The Products of Animal Origin (Import and Export) Regulations 1996(3) are amended as follows.

(2) In regulation 1(2) the definition of “Divisional Veterinary Manager” is revoked.

(3) In regulations 13(5) and (6) and 16(8), for the words “appropriate Divisional Veterinary Manager”, in each place that they occur, substitute “Welsh Ministers”.

Amendment to the Foot-and-Mouth Disease (Control of Vaccination) (Wales) Regulations 2006

3.  In regulation 23(1) of the Foot-and-Mouth Disease (Control of Vaccination) (Wales) Regulations 2006(4), for “Divisional Veterinary Manager of the State Veterinary Service for the area in which that animal is located” substitute “Welsh Ministers”.

Amendment to the Avian Influenza (Preventive Measures) (Wales) Regulations 2006

4.  In regulation 13 of the Avian Influenza (Preventive Measures) (Wales) Regulations 2006(5), for “Divisional Veterinary Manager appointed by the National Assembly for the area in which that bird is located” substitute “Welsh Ministers”.

Amendment to the Avian Influenza (Vaccination) (Wales) (No. 2) Regulations 2006

5.  For regulation 11 of the Avian Influenza (Vaccination) (Wales) (No. 2) Regulations 2006(6) substitute—

11.  Any person who knows or suspects that a bird has not been vaccinated as required by the Welsh Ministers must notify them immediately.

Amendment to the Bluetongue (Wales) Regulations 2008

6.—(1) The Bluetongue (Wales) Regulations 2008(7) are amended as follows.

(2) Regulation 8(3) is revoked.

(3) In regulations 8(1)(a) and (2) and 11(b) for “Divisional Veterinary Manager” substitute “Welsh Ministers”.

Explanatory Note

(This note is not part of the Regulations )

These Regulations replace references to “Divisional Veterinary Manager” with “Welsh Ministers” in–

(a)the Products of Animal Origin (Import and Export) Regulations 1996;

(b)the Foot-and-Mouth Disease (Control of Vaccination) (Wales) Regulations 2006;

(c)the Avian Influenza (Preventive Measures) (Wales) Regulations 2006;

(d)the Avian Influenza (Vaccination) (Wales) (No. 2) Regulations 2006; and

(e)the Bluetongue (Wales) Regulations 2008.

A regulatory impact assessment has not been prepared for these Regulations as no impact on the private, public or voluntary sectors is foreseen.

S.I 2005/2766. By virtue of sections 59 and 162 of, and paragraphs 28 and 30 of Schedule 11 to the Government of Wales Act 2006, functions conferred upon the National Assembly for Wales are exercisable by the Welsh Ministers.
