The Welsh Ministers are designated() for the purposes of section 2(2) of the European Communities Act 1972() in relation to the quality of water intended for domestic purposes or for use in a food production undertaking.
These Regulations make provision for a purpose mentioned in that section and it appears to the Welsh Ministers that it is expedient for the reference to Council Directive 89/106/EEC on the approximation of laws, regulations and administrative provisions of the Member States relating to construction products() and to Directive 98/34/EC of the European Parliament and of the Council laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on Information Society services() to be construed as references to those instruments as amended from time to time.
The Welsh Ministers make these Regulations in exercise of the powers conferred upon them by section 2(2) of the European Communities Act 1972 and section 67, 69, 77(3) and (4) and 213(2) of the Water Industry Act 1991():
