18.—(1) Mae Deddf Prynu Gorfodol (Datganiadau Breinio) 1981(1) yn gymwys fel pe bai'r Gorchymyn hwn yn orchymyn prynu gorfodol.
(2) Mae Deddf Prynu Gorfodol (Datganiadau Breinio) 1981, fel y'i cymhwysir gan baragraff (1) yn cael effaith gyda'r addasiadau canlynol.
(3) Yn adran 3 (hysbysiadau rhagarweiniol), yn lle is-adran (1) rhodder—
“(1) Before making a declaration under section 4 with respect to any land which is subject to a compulsory purchase order the acquiring authority must include the particulars specified in subsection (3) in a notice which is—
(a)given to every person with a relevant interest in the land with respect to which the declaration is to be made (other than a mortgagee who is not in possession); and
(b)published in a local newspaper circulating in the area in which the land is situated.”.
(4) Yn yr adran honno, yn is-adran (2), yn lle “(1)(b)” rhodder “(1)” ac ar ôl “given” mewnosoder “and published”.
(5) Yn yr adran honno, yn lle is-adrannau (5) a (6) rhodder—
“(5) For the purposes of this section, a person has a relevant interest in land if—
(a)he is for the time being entitled to dispose of the fee simple of the land, whether in possession or reversion; or
(b)he holds, or is entitled to the rents and profits of, the land under a lease or agreement, the unexpired term of which exceeds one month.”.
(6) Yn adran 5 (dyddiad cynharaf ar gyfer gweithredu datganiad)—
(a)yn is-adran (1), ar ôl “publication” mewnosoder “in a local newspaper circulating in the area in which the land is situated”; a
(b)hepgorer is-adran (2).
(7) Yn adran 7 (hysbysiad deongliadol i drafod telerau) yn is-adran (1)(a), hepgorer y geiriau “(as modified by section 4 of the Acquisition of Land Act 1981)”.
(8) Rhaid dehongli cyfeiriadau at Ddeddf 1965 fel cyfeiriadau at y Ddeddf honno fel y'i cymhwysir i gaffael tir o dan erthygl 17 (cymhwyso Rhan 1 o Ddeddf Prynu Gorfodol 1965).
