Apelau mewn perthynas â thrwyddedau gweithiau neu garthu

45.—(1) Pan fo—

(a)y Comisiynwyr wedi gwrthod caniatáu trwydded gweithiau neu drwydded garthu a'r ceisydd am y drwydded wedi ei dramgwyddo gan y gwrthodiad; neu

(b)y Comisiynwyr wedi caniatáu trwydded o'r fath ar delerau neu amodau neu wedi ei gwneud yn ofynnol addasu'r planiau, trychiadau a manylion a gyflwynwyd gan y ceisydd, a'r ceisydd wedi ei dramgwyddo gan benderfyniad y Comisiynwyr ynglŷn â'r cyfryw delerau neu amodau neu ynglŷn â'r cyfryw addasiadau;

caiff y ceisydd, o fewn 28 diwrnod o'r dyddiad y rhoddodd y Comisiynwyr hysbysiad o'u penderfyniad, neu'r dyddiad yr ystyrir o dan erthygl 43 neu 44 eu bod wedi gwrthod y cais, yn ôl fel y digwydd, apelio i Weinidogion Cymru.

(2) Rhaid gwneud apêl o dan baragraff (1) drwy hysbysiad ysgrifenedig, gan nodi seiliau'r apêl.

(3) Rhaid i berson sy'n apelio i Weinidogion Cymru o dan yr erthygl hon anfon, ar yr un pryd, gopi o'r datganiad o apêl at y Comisiynwyr, a rhaid i'r Comisiynwyr, cyn gynted ag y bo'n ymarferol wedyn, ddarparu'r holl ddogfennau perthnasol i Weinidogion Cymru, ac o fewn 28 diwrnod o gael y datganiad o apêl, cânt ddarparu i Weinidogion Cymru eu sylwadau ar yr apêl.

(4) Yn dilyn apêl o dan yr erthygl hon, caiff Gweinidogion Cymru gadarnhau, amrywio neu ddirymu'r penderfyniad yr apeliwyd yn ei erbyn a gorchymyn gwneud yn ofynnol unrhyw ddiwygiadau canlyniadol, gan gynnwys diwygio'r telerau ac amodau neu'r addasiadau i blaniau, trychiadau a manylion.

(5) Rhaid i'r Comisiynwyr roi effaith i unrhyw benderfyniad neu ofyniad a roddir neu a wneir gan Weinidogion Cymru o dan baragraff (4).
