Nodyn Esboniadol

(Nid yw'r nodyn hwn yn rhan o'r Rheoliadau)

Yn unol â Phennod 1 o Ran 2 o Ddeddf Cyfunddaliad a Diwygio Cyfraith Lesddaliad 2002 (“Deddf 2002”), caiff cwmni, y cyfeirir ato yn y Bennod honno fel cwmni RTM (hawl i reoli), gaffael ac arfer hawliau mewn perthynas â rheoli mangreoedd. Mae adran 73(2) o Ddeddf 2002 yn darparu bod cwmni yn gwmni RTM mewn perthynas â mangreoedd os yw'n gwmni preifat cyfyngedig drwy warant a'i erthyglau cymdeithasu yn datgan mai ei amcan, neu un o'i amcanion, yw caffael ac arfer yr hawl i reoli'r fangre honno. Mae is-adrannau (3) i (5) o'r adran honno yn disgrifio cwmnïau nad ydynt yn gwmnïau RTM a'r amgylchiadau pan fo cwmni RTM yn peidio â bod yn gwmni o'r disgrifiad hwnnw. Mae adran 74(2) o Ddeddf 2002 yn darparu bod rhaid i'r “awdurdod gwladol priodol” (“the appropriate national authority”) wneud rheoliadau ynghylch cynnwys a ffurf erthyglau cymdeithasu cwmnïau RTM. Mae adran 179(1) o Ddeddf 2002 yn darparu mai Gweinidogion Cymru yw'r “awdurdod gwladol priodol ” mewn perthynas â Chymru.

Mae'r Rheoliadau hyn, sy'n gymwys o ran Cymru, drwy gyfeirio at yr Atodlenni i'r Rheoliadau hyn, yn rhagnodi ffurf a chynnwys erthyglau cymdeithasu cwmnïau RTM. Mae Atodlen 1 yn cynnwys erthyglau enghreifftiol yn Saesneg ac Atodlen 2 yn cynnwys erthyglau enghreifftiol yn Gymraeg. Mae'r Rheoliadau hyn yn cynnwys darpariaeth, a awdurdodir gan adran 74(4) o Ddeddf 2002, i'r perwyl bod yr erthyglau enghreifftiol yn cael effaith ar gyfer cwmni RTM, pa un a fabwysiedir yr erthyglau ai peidio.

Mae'r Rheoliadau hyn yn dirymu Rheoliadau Cwmnïau RTM (Memorandwm ac Erthyglau Cymdeithasu) (Cymru) 2004.
