The Red Meat Industry (Wales) Measure 2010 (Commencement, Transitional and Saving Provisions Order 2011

The Welsh Ministers make the following Order in exercise of powers conferred by sections 17(2) and 18 of the Red Meat Industry (Wales) Measure 2010(1).

Title, application and interpretation

1.—(1) The title of this Order is the Red Meat Industry (Wales) Measure 2010 (Commencement, Transitional and Saving Povisions) Order 2011.

(2) This Order applies in relation to Wales.

(3) In this Order—

(a)"the Measure" ("y Mesur") means the Red Meat Industry (Wales) Measure 2010;

(b)"the Levy Order" ("y Gorchymyn Ardollau") means the Welsh Levy Board Order 2008(2);

(c)"2011/2012 financial year" ("blwyddyn ariannol 2011/2012") means 1 April 2011 to 31 March 2012 inclusive.

Provisions coming into force on 1 April 2012

2.  Subject to articles 3 and 4, the provisions of the Measure insofar as they are not already in force come into force as follows—

(1) sections 4(3) and 5(4) on 28 November 2011;

(2) the remaining sections on 1 April 2012.

Transitional Provision

3.—(1) In respect of the 2011/2012 financial year the Welsh Levy Board's obligations under articles 13(3)(b) (prepare accounts) and 13(4) (submit accounts to the Auditor General for Wales) of the Levy Order are transferred to the Welsh Ministers.

(2) Any matters arising from the accounts that require further action are the responsibility of the Welsh Ministers.

Saving Provision

4.  In respect of the accounts prepared for the 2011/2012 financial year, the obligation of the Auditor General for Wales under article 13(5) (examine, certify, report and lay accounts) of the Levy Order is to continue to have effect.

Explanatory Note

(This note is not part of the Order)

This Order commences provisions of the Red Meat Industry (Wales) Measure 2010 (nawm 3) ("the Measure").

Article 2 of the Order brings into force articles 4(3) and 5(4) on 28 November 2011. The remaining provisions of the Measure insofar as they are not already in force are brought into force on 1 April 2012.

Article 3 of the Order contains transitional provisions about the preparation and submission to the Auditor General for Wales of the Welsh Levy Board's accounts for the financial year 1 April 2011 to 31 March 2012 ("the 2011/2012 financial year"). The preparation of and any matters arising from those accounts are the responsibility of the Welsh Ministers.

Article 4 of the Order contains a saving provision which preserves the obligation of the Auditor General for Wales to examine, certify, report on and lay before the National Assembly the accounts of the Welsh Levy Board for the 2011/2012 financial year.
