Nodyn Esboniadol

(Nid yw'r nodyn hwn yn rhan o'r Gorchymyn)

Mae'r Gorchymyn hwn, a wnaed o dan Ddeddf Iechyd Anifeiliaid 1981 yn rhoi pwerau i Weinidogion Cymru mewn perthynas â thwbercwlosis yng Nghymru.

Mae Rhan 1 yn gwneud darpariaethau cyffredinol, gan gynnwys enwi, cychwyn a dehongli. Mae erthygl 3 yn darparu ar gyfer dirymu Gorchymyn Twbercwlosis (Ceirw) 1989 a Gorchymyn Twbercwlosis (Ceirw) Hysbysiad o Gigydda Arfaethedig ac Iawndal 1989 o ran Cymru. Mae erthygl 3 hefyd yn diwygio Gorchymyn Twbercwlosis (Cymru) 2010. Mae erthygl 4 yn darparu ar gyfer arbedion a phontio.

Mae Rhan 2 yn gwneud darpariaeth ar gyfer profi a symud anifeiliaid nad ydynt yn anifeiliaid buchol. Mae erthygl 5 yn cyflwyno gofyniad bod rhaid cael dull o adnabod anifeiliaid nad ydynt yn anifeiliaid buchol penodol. Mae erthygl 6 yn gwneud darpariaeth ynglŷn â hysbysu am glefydau. Mae erthyglau 7 ac 8 yn gwneud darpariaeth ynglŷn ag arolygwyr milfeddygol. Mae erthyglau 9 a 10 yn gwneud darpariaeth ynglŷn â phrofi anifeiliaid nad ydynt yn anifeiliaid buchol. Mae erthyglau 11 i 19 yn gwneud darpariaeth ynglŷn â rheolaethau at y diben o atal clefydau rhag lledaenu.

Mae Rhan 3 yn gwneud darpariaeth ynglŷn ag iawndal am anifeiliaid nad ydynt yn anifeiliaid buchol, a gigyddir oherwydd twbercwlosis. Mae erthygl 20 yn darparu ar gyfer cyfrifo swm yr iawndal. Yn yr erthygl honno hefyd darperir ar gyfer panel i adolygu'r cyfrifiad o werth anifail nad yw'n anifail buchol.

Paratowyd asesiad effaith rheoleiddiol mewn perthynas â'r Gorchymyn hwn, a gellir cael copi ohono o Swyddfa Prif Swyddog Milfeddygol Cymru, Llywodraeth Cynulliad Cymru, Parc Cathays, Caerdydd, CF10 3NQ.
