RHAN 3Iawndal
Iawndal am anifeiliaid nad ydynt yn anifeiliaid buchol a gigyddir oherwydd twbercwlosis
20.—(1) Pan fo—
(a)Gweinidogion Cymru yn peri cigydda anifail nad yw'n anifail buchol, o dan bwerau a roddir gan adran 32(1) o'r Ddeddf (cigydda oherwydd clefydau eraill) fel y'i cymhwysir i dwbercwlosis; a
(b)yr anifail hwnnw nad yw'n anifail buchol yn un a adwaenir—
(i)yn unol â Gorchymyn Defaid a Geifr (Cofnodion, Adnabod a Symud) (Cymru) 2009(1), pan fo'n afr; neu
(ii)yn unol ag erthygl 5, ym mhob achos arall,
yr iawndal taladwy o dan adran 32(3) mewn perthynas â'r anifail hwnnw nad yw'n anifail buchol fydd ei werth fel y'i cyfrifir yn unol â'r Atodlen.
(2) Mae rheoliad 3 o Reoliadau Cynlluniau Cymorthdaliadau a Grantiau Amaethyddol (Apelau) (Cymru) 2006(2) (darparu gweithdrefn apelio) yn gymwys ar gyfer penderfynu'r ffigur priodol, fel pe bai'r penderfyniad hwnnw'n benderfyniad perthnasol.
(3) Ym mharagraff (2) ystyr “ffigur priodol” (“appropriate figure”) yw'r ffigur a ddarperir ar gyfer “B” gan un o baragraffau 2 i 5 o'r Atodlen.
