Troseddau mynd yn groes i ddarpariaethau penodedig yn Rheoliad 10/2011

14.—(1) Yn ddarostyngedig i'r trefniadau trosiannol a nodir yn Erthygl 22(4) a (5) ac Erthygl 23(1), bydd unrhyw berson sy'n rhoi ar y farchnad ddeunydd neu eitem blastig nad yw'n cydymffurfio â gofyniad yn Rheoliad 10/2011 a bennir yng ngholofn 1 o'r Atodlen yn euog o drosedd.

(2) Bydd unrhyw berson sy'n methu â chydymffurfio ag ail frawddeg Erthygl 8 (gofynion cyffredinol o ran sylweddau) neu, yn ddarostyngedig i'r trefniadau trosiannol a nodir yn Erthygl 22(1), (2) a (3)(2), gydag Erthygl 16 (dogfennaeth ategol) yn euog o drosedd.

Mae Erthygl 22(4) yn darparu bod yn rhaid i ychwanegion penodol a ddefnyddir mewn seis ffibr gwydr gael eu hasesu o dan Erthygl 19 a hynny hyd 31 Rhagfyr 2015. Mae Erthygl 22(5) yn darparu y caniateir i ddeunyddiau ac eitemau a roddwyd yn gyfreithlon ar y farchnad cyn 1 Mai 2011 gael eu rhoi ar y farchnad hyd 31 Rhagfyr 2012. Mae Erthygl 23 yn darparu, o ran y mathau penodol o ddefnydd a wneir ar ychwanegion, fod Erthygl 5 yn gymwys o 31 Rhagfyr 2015 ymlaen a bod darpariaethau Erthygl 18(2) a (4) ac Erthygl 20 yn gymwys o 31 Rhagfyr 2012 ymlaen.

Mae paragraffau (1), (2) a (3) o Erthygl 22 yn darparu bod yn rhaid i'r dogfennau ategol y cyfeirir atynt yn Erthygl 16, hyd 31 Rhagfyr 2012, fod yn seiliedig ar y rheolau yng Nghyfarwyddeb 82/711/EEC: sef bod rhaid i ddogfennau o'r fath, o 1 Ionawr 2013 hyd 31 Rhagfyr 2015, fod yn seiliedig ar y rheolau yn Erthygl 18 o'r Rheoliad hwnnw
