Enwi, cychwyn a chymhwyso

1.—(1Enw'r Rheoliadau hyn yw Rheoliadau Panel Cynghori Comisiynydd y Gymraeg (Penodi) 2012.

(2Mae'r Rheoliadau hyn yn dod i rym ar 6 Chwefror 2012 ac maent yn gymwys o ran Cymru.

Yr egwyddorion i'w dilyn

2.  Wrth benodi aelodau o'r Panel Cynghori rhaid i Weinidogion Cymru ddilyn egwyddorion cyfrifoldeb gweinidogion, teilyngdod, craffu annibynnol, cyfle cyfartal, uniondeb, didwylledd a thryloywder, a chymesuredd gan gymryd i ystyriaeth y disgrifiad o'r egwyddorion hynny yng Nghod Ymarfer y Comisiynydd Penodiadau Cyhoeddus ar gyfer Penodiadau gan Weinidogion i Gyrff Gyhoeddus dyddiedig Awst 2009.

Gwybodaeth o'r Gymraeg a hyfedredd ynddi

3.  Wrth benodi personau yn aelodau o'r Panel Cynghori rhaid i Weinidogion Cymru roi ystyriaeth i'r ffaith ei bod yn ddymunol bod aelodaeth y Panel Cynghori yn cynnwys personau sydd â gwybodaeth o'r Gymraeg a hyfedredd ynddi.

Gwybodaeth a phrofiad

4.—(1Cyn penodi personau yn aelodau o'r Panel Cynghori rhaid i Weinidogion Cymru, i'r graddau sy'n rhesymol ymarferol, ganfod gwybodaeth a phrofiad y Comisiynydd o'r materion canlynol—

(a)llywodraethu corfforaethol;

(b)arfer swyddogaethau sydd wedi'i rhoi gan neu o dan ddeddfiad;

(c)hybu a hwyluso defnydd o'r Gymraeg neu iaith arall;

(ch)cysylltiadau cyhoeddus;

(d)cyfundrefnau rheoleiddiol; a

(dd)gweithio mewn partneriaeth â sefydliadau yn y sectorau preifat, cyhoeddus, neu wirfoddol.

(2Wrth benodi personau yn aelodau o'r Panel Cynghori rhaid i Weinidogion Cymru roi ystyriaeth i'r ffaith ei bod yn ddymunol bod gwybodaeth a phrofiad y Comisiynydd ac aelodau'r Panel Cynghori (gyda'i gilydd) yn cynnwys gwybodaeth a phrofiad o'r materion y cyfeirir atynt ym mharagraff (1).
