Cofrestru hawliau comin dros dir cyfnewid

5.—(1) Pan fo awdurdod cofrestru tiroedd comin, yn unol â gorchymyn dadgofrestru a chyfnewid, yn cofrestru tir cyfnewid drwy fewnosod uned cofrestr newydd mewn perthynas â'r tir hwnnw, mae'r darpariaethau canlynol yn gymwys, yn ddarostyngedig i unrhyw ddarpariaethau yn y gorchymyn sy'n pennu'r modd y mae hawliau comin i'w cofrestru fel rhai arferadwy dros y tir cyfnewid.

(2) Os oedd hawliau comin, yn union cyn dadgofrestru'r tir rhyddhau, wedi eu cofrestru fel rhai arferadwy dros y tir rhyddhau ac nid unrhyw dir arall, rhaid i'r awdurdod cofrestru gofrestru'r hawliau hynny fel rhai arferadwy dros y tir cyfnewid, drwy ddilyn Cofnod Enghreifftiol 7 mor agos ag y bo modd, gyda pha bynnag amrywiadau ac addasiadau sy'n ofynnol yn yr amgylchiadau, a chan hepgor o golofn 4 y geiriau o “except” ymlaen i'r diwedd.

(3) Os oedd hawliau comin, yn union cyn dadgofrestru'r tir rhyddhau, wedi eu cofrestru fel rhai arferadwy dros ddarn o dir a gyfansoddir o'r tir rhyddhau (Darn A) a thir arall (Darn B), rhaid i'r awdurdod cofrestru gofrestru'r hawliau hynny fel rhai sy'n arferadwy dros y tir cyfnewid yn ychwanegol at barhau'n arferadwy dros Ddarn B, yn unol â Chofnodion Enghreifftiol 33 (mewn perthynas â Darn B) a 34 (mewn perthynas â'r tir cyfnewid) gyda pha bynnag amrywiadau ac addasiadau sy'n ofynnol yn yr amgylchiadau.
