NODYN ESBONIADOL

(Nid yw’r nodyn hwn yn rhan o’r Gorchymyn)

Mae’r Gorchymyn hwn yn diwygio Gorchymyn Cynllunio Gwlad a Thref (Datblygu Cyffredinol a Ganiateir) 1995 (“Gorchymyn 1995”). Mae Gorchymyn 1995 yn rhoi hawliau datblygu a ganiateir mewn perthynas â datblygu penodol. Pan fo’r hawliau hynny yn gymwys, nid oes angen gwneud cais penodol am ganiatâd cynllunio.

Mae erthygl 2 a’r Atodlen yn rhoi Rhan 1 newydd yn lle Rhan 1 o Atodlen 2 i Orchymyn 1995. Mae Rhan 1 o Atodlen 2 yn rhoi hawliau datblygu a ganiateir mewn perthynas â datblygu o fewn cwrtil tŷ annedd. Mae’r Rhan 1 newydd o Atodlen 2 yn gwneud newidiadau i’r hawliau datblygu a ganiateir mewn perthynas ag ehangu, gwella neu addasu tŷ annedd (Dosbarth A); ehangu tŷ annedd sy’n cynnwys ychwanegiad neu addasiad i’r to (Dosbarth B); unrhyw addasiad arall i do tŷ annedd (Dosbarth C); y ddarpariaeth o fewn cwrtil unrhyw adeilad, clostir, bwll neu gynhwysydd (Dosbarth E); a’r ddarpariaeth o fewn cwrtil arwyneb caled (Dosbarth F). Caiff y Dosbarth G blaenorol (adeilad neu ddarpariaeth o fewn cwrtil cynhwysydd) ei gynnwys yn y Dosbarth E newydd. Mae Dosbarth G newydd yn rhoi hawliau datblygu a ganiateir mewn perthynas â gosod, addasu neu amnewid simnai. Caiff Dosbarth H (gosod, addasu neu amnewid antena microdon) ei ddiwygio i ddarparu ar gyfer pan gaiff antena ei drin fel bod yn weladwy o briffordd.

Mae Dosbarth D (codi neu adeiladu porth) heb ei newid.

Mae asesiad effaith wedi ei baratoi mewn perthynas â’r Rheoliadau hyn. Mae copïau ar gael oddi wrth: Llywodraeth Cymru, Parc Cathays, Caerdydd, CF10 3NQ ac ar wefan Llywodraeth Cymru yn www.cymru.gov.uk.
