Mae Gweinidogion Cymru yn gwneud y Gorchymyn hwn drwy arfer y pwerau a roddwyd gan adrannau 13, 14, 15 a 35 o Ddeddf Cyrff Cyhoeddus 2011(1) (“y Ddeddf”).
O ran y Gorchymyn hwn, yn unol ag adran 16 o'r Ddeddf, mae Gweinidogion Cymru o'r farn—
(a)ei fod yn ateb diben gwella'r broses o arfer swyddogaethau cyhoeddus, o roi sylw i'r ffactorau a nodir yn adran 16 o'r Ddeddf; a
(b)nad yw'n dileu unrhyw ddiogelwch angenrheidiol nac yn atal neb rhag parhau i arfer unrhyw hawl neu ryddid y gallai'r person hwnnw ddisgwyl yn rhesymol barhau i'w harfer neu i'w arfer.
Mae cydsyniad yr Ysgrifennydd Gwladol a'r Gweinidog wedi ei sicrhau yn unol ag adran 17 o'r Ddeddf.
Mae Gweinidogion Cymru wedi ymgynghori yn unol ag adran 18 o'r Ddeddf.
Mae drafft o'r Gorchymyn hwn, a dogfen esboniadol sy'n cynnwys yr wybodaeth sy'n ofynnol o dan adran 19(2) o'r Ddeddf, wedi eu gosod gerbron Cynulliad Cenedlaethol Cymru yn unol ag adran 19(1) ar ôl diwedd y cyfnod o ddeuddeng wythnos a grybwyllir yn adran 19(3).
Yn unol ag adran 19(6) o'r Ddeddf, mae Gweinidogion Cymru wedi rhoi sylw i'r sylwadau a'r argymhellion a wnaed yn ystod y cyfnod o 60 niwrnod o ran y Gorchymyn drafft.
Yn unol ag adran 19(8) o'r Ddeddf, mae drafft diwygiedig o'r Gorchymyn hwn, a datganiad yn rhoi crynodeb o'r newidiadau arfaethedig, wedi eu gosod gerbron Cynulliad Cenedlaethol Cymru ar ôl i'r cyfnod o 60 niwrnod ddod i ben.
Mae'r drafft diwygiedig o'r Gorchymyn hwn wedi ei gymeradwyo drwy benderfyniad gan Gynulliad Cenedlaethol Cymru yn unol ag adran 19(9) o'r Ddeddf.
