Section 221 is amended as follows.

In subsection (2), for “Environment Agency” substitute “ appropriate agency ”.

In subsection (7), in the appropriate place insert—

“the appropriate agency” means—

a

in relation to any act or omission of the Crown in England, the Agency;

b

in relation to any act or omission of the Crown in Wales, the NRBW;
