Forest Reproductive Material (Great Britain) Regulations 2002

138.—(1) Regulation 2 is amended as follows.

(2) In paragraph (2)—

(a)in the appropriate place insert—

“the appropriate authority”—

(a)

in regulations 7 to 9, 20(b) and Schedules 2 to 5, has the meaning given in regulation 7(11);

(b)

in regulations 11, 13 and 14, has the meaning given in regulation 11(4);

(c)

in regulations 16, 18 and 22, has the meaning given in regulation 16(1B);

(d)

in regulation 25, has the meaning given in regulation 25(4);;

(b)for the definition of “authorised officer” substitute—

“authorised officer” means—

(a)

a person authorised by the Commissioners to exercise their powers and execute their functions under these Regulations; and

(b)

a person authorised by the Welsh Ministers to exercise their powers and execute their functions under these Regulations;;

(c)in the definition of “Master Certificate”, for “Great Britain” substitute “ a relevant territory”;

(d)in the definitions of “official certificate” and “region of provenance”, after “the Commissioners” insert “or the Welsh Ministers”;

(e)in the appropriate place insert—

“relevant territory” means—

(a)

England and Scotland; and

(b)

Wales;.

(3) In paragraph (6)—

(a)omit “Commissioners'”;

(b)after “payable to the Commissioners” insert “or the Welsh Ministers”.
