The Welsh Ministers are designated in relation to measures relating to water resources (1) for the purposes of section 2(2) of the European Communities Act 1972 (2).

The Welsh Ministers make the following Regulations in exercise of the powers conferred by that section of that Act.

The Welsh Ministers have chosen to consult in relation to regulation 6 of the Bathing Water Regulations 2013 (“the Regulations”) (3).

Title, commencement and application

1.—(1) The title of these Regulations is the Bathing Water (Amendment) (Wales) Regulations 2014.

(2) These Regulations come into force on 15 May 2014.

(3) These Regulations apply to Wales.

Variation of Part 2 of Schedule 2 to the Bathing Water Regulations 2013

2.—(1) The Regulations are amended as follows.

(2) In Part 2 of Schedule 2 (surface waters in Wales)—

(a)after “Llanrhystud”, insert “Llyn Padarn”; and

(b)after “Rhyl”, insert “Rhyl East”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations, which apply in relation to Wales, vary Part 2 of Schedule 2 (surface waters in Wales) to the Bathing Water Regulations 2013 (“the Regulations”), which lists the waters identified by the Welsh Ministers as bathing waters in Wales.

Regulation 2 of these Regulations adds Llyn Padarn and Rhyl East to the list of identified bathing waters in the Regulations.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. No Regulatory Impact Assessment has been produced for these amended regulations as there is no change to policy, or impact on business or the voluntary sectors foreseen.
