The Agricultural Sector (Wales) Act 2014 (Consequential Modification) Order 2015

The Welsh Ministers, in exercise of the powers conferred on them by section 16 of the Agricultural Sector (Wales) Act 2014(1), make the following Order.

In accordance with section 17(2) of that Act, a draft of this instrument was laid before and approved by resolution of the National Assembly for Wales.

Title, commencement and application

1.—(1) The title of this Order is the Agricultural Sector (Wales) Act 2014 (Consequential Modification) Order 2015 and it comes into force on 9 December 2015.

(2) This Order applies in relation to Wales.

Modification of the National Minimum Wage Act 1998

2.  Section 46(4) of the National Minimum Wage Act 1998(2) is modified as follows—

(a)at the end of paragraph (b) omit “and”;

(b)at the end of paragraph (c) insert—

; and

(d)the Agricultural Sector (Wales) Act 2014.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order makes a consequential modification to the National Minimum Wage Act 1998 (“the 1998 Act”).

Article 2 of this Order amends section 46(4) of the 1998 Act by inserting a reference to the Agricultural Sector (Wales) Act 2014 (“the 2014 Act”). The provision ensures that a person cannot be prosecuted under both the 1998 Act and the 2014 Act for an offence arising out of the same conduct.

A Regulatory Impact Assessment has not been prepared for this Order as no impact on the public, private, charity or voluntary sectors is foreseen.

1998 c. 39. Section 46(4)(a) has been repealed by section 72 of and paragraph 2 of Schedule 20 to the Enterprise and Regulatory Reform Act 2013. The repeal does not yet have effect in Wales.
