NODYN ESBONIADOL
(Nid yw’r nodyn hwn yn rhan o’r Rheoliadau)
Mae’r Rheoliadau hyn, sy’n gymwys o ran Cymru, yn cael eu gwneud o dan Ddeddf Seilwaith 2015 (p.7) (“Deddf 2015”).
Mae rheoliad 2 yn dwyn Rhan 4 o Ddeddf 2015 (rheolaeth amgylcheddol ar rywogaethau o anifeiliaid a phlanhigion), sef adrannau 23, 24 a 25, i rym ar 12 Ebrill 2015 mewn perthynas â Chymru.
Mae adran 23 o Ddeddf 2015 yn mewnosod isadran 14(4A) newydd i Ddeddf Bywyd Gwyllt a Chefn Gwlad 1981 (p.69) (“Deddf 1981”) sy’n darparu bod mesurau sy’n ymwneud â chytundebau rheoli rhywogaethau a gorchmynion rheoli rhywogaethau yn cael eu cynnwys mewn Atodlen 9A newydd i’r Ddeddf honno.
Mae adran 24 o Ddeddf 2015 yn diwygio Rhan I o Atodlen 9 i Ddeddf 1981 fel ei bod yn cael ei rhannu yn dair Rhan benodol.
Mae adran 25 o Ddeddf 2015 yn gwneud newidiadau canlyniadol i Ddeddf 1981.
Ystyriwyd Cod Ymarfer Gweinidogion Cymru ar gynnal Asesiadau Effaith Rheoleiddiol mewn perthynas â’r Rheoliadau hyn. O ganlyniad, ystyriwyd nad oedd yn angenrheidiol cynnal asesiad effaith rheoleiddiol o’r costau a’r manteision sy’n debygol o ddeillio o gydymffurfio â’r Rheoliadau hyn.
