Dyletswydd i ymgynghori cyn rhoi caniatâd
22.—(1) Rhaid i Weinidogion Cymru, o fewn y cyfnod sylwadau, ymgynghori ag unrhyw ymgynghorai arbenigol, ac eithrio pan fo ymgynghorai arbenigol wedi rhoi gwybod i Weinidogion Cymru nad yw’n dymuno iddynt ymgynghori ag ef.
(2) Nid yw’r eithriad ym mharagraff (1) yn gymwys pan fo’r datblygiad, ym marn Gweinidogion Cymru, yn dod o fewn paragraff (t) o’r Tabl yn Atodlen 5.
(3) Caiff Gweinidogion Cymru, mewn unrhyw achos neu ddosbarth o achosion, ymgynghori hefyd ag unrhyw awdurdod, corff neu berson yn ychwanegol i’r rhai a bennir yn Atodlen 5.
(4) Os gwneir yn ofynnol, gan neu o dan yr erthygl hon, fod Gweinidogion Cymru yn ymgynghori ag unrhyw ymgynghorai arbenigol cyn rhoi caniatâd cynllunio—
(a)rhaid iddynt roi hysbysiad o’r cais i’r ymgynghorai arbenigol hwnnw; a
(b)rhaid iddynt beidio â phenderfynu’r cais tan o leiaf 21 diwrnod ar ôl y dyddiad y rhoddir yr hysbysiad o dan is-baragraff (a).
(5) Rhaid i Weinidogion Cymru, wrth benderfynu’r cais, gymryd i ystyriaeth unrhyw sylwadau a gânt gan ymgynghorai arbenigol.
