The Regulated Services (Annual Returns) (Wales) Regulations 2017

Coming into force
The Welsh Ministers make the following Regulations in exercise of the powers conferred by section 10(2)(a)(vii), (viii) and (ix), (3) and (4) and section 187(1) of the Regulation and Inspection of Social Care (Wales) Act 2016 M1.
A draft of these Regulations was laid before the National Assembly for Wales under section 10(6) of that Act and has been approved by a resolution of the National Assembly for Wales.
Title, commencement and application1

The title of these Regulations is the Regulated Services (Annual Returns) (Wales) Regulations 2017.

These Regulations come into force on 2 April 2018 and apply in relation to Wales.
Interpretation2
In these Regulations—
“the Act” (“y Ddeddf”) means the Regulation and Inspection of Social Care (Wales) Act 2016;
“annual return” (“datganiad blynyddol”) means the annual return which a service provider must submit to the Welsh Ministers in accordance with section 10(1) of the Act.
F6Application of these Regulations to annual returns for specified financial years2A
The following provisions of these Regulations do not apply to annual returns submitted for any of the financial years specified in regulation 10(1)—
a
regulations 3 to 6;
b
the Schedule.
Information about training3
An annual return must contain a description of the arrangements in place for identifying, planning and meeting the training needs of staff employed by the service provider in relation to each of the regulated services which the service provider is registered to provide.
Information about workforce planning4
An annual return must contain a description of the arrangements in place for the recruitment and retention of staff employed by the service provider in relation to the regulated services which the service provider is registered to provide.
Other information5
An annual return which is submitted by a service provider who is registered to provide a care home service, a secure accommodation service or a residential family centre service must contain the additional information specified in the Schedule in relation to each of the places at which the service is provided.

An annual return which is submitted by a service provider who is registered to provide a domiciliary support service F1, an adoption service, a fostering service, an adult placement service or an advocacy service must contain the additional information specified in the Schedule in relation to each of the places in relation to which the service is provided.
Declaration of truth7
An annual return must contain a signed declaration by the service provider confirming that they have read and agree with the information contained in the annual return which relates to the regulated services that the provider is registered to provide.

An annual return must contain a signed declaration by each responsible individual confirming that they have read and agree with the information contained in the annual return which relates to the place at, from or in relation to which they have been designated by the service provider as the responsible individual.
Form of annual return9
An annual return must be in the form of an on-line return which is accessed from the pages of the website maintained by the Welsh Government which have been established for the purpose of informing service providers of the requirements for the preparation and submission of annual returns.

An annual return relating to a subsequent financial year must be submitted to the Welsh Ministers within 56 days of the end of the financial year to which it relates.

The name of the responsible individual.
Information about staffing3
The name of the manager.

The total number of full time equivalent posts (including filled and vacant posts).

The number of filled and vacant posts in each of the following categories—
a
manager;
b
deputy Manager;
c
other supervisory staff;
d
nursing care staff;
e
registered nurses;
f
senior social care staff providing direct care;
g
other social care staff providing direct care;
h
domestic staff;
i
catering staff;
j
other types of staff not listed above F2;
F3but sub-paragraphs (d), (e), (h), and (i) do not apply if a service provider is registered only to provide an adoption service, a fostering service, an adult placement service or an advocacy service.

If the number of staff employed includes staff of a type not listed in paragraph 5(a) to (i), details of the type or types of such staff.

The rate of staff turnover.

The types of contractual arrangements on which staff are employed and the number of staff employed on each type of contractual arrangement in each of the categories listed in paragraph 5.

The qualifications of staff employed in each of the categories listed in paragraph 5.

Details of any relevant training which has been undertaken by staff employed in each of the categories listed in paragraph 5 during the period in which they have been employed by the service provider.
Information about the service provision11
Details of the scale of charges payable by service users during the last financial year.

Details of the languages used in providing the service.

Details of any non-verbal communication methods used.

The total number of formal complaints made during the last financial year and the proportion of those complaints which were not upheld, partially upheld and upheld.

Details of the arrangements made for consulting service users about the operation of the regulated service.
Additional information where the service involves the provision of accommodation16
The typical shift patterns of staff employed, showing the number of staff in each of the categories listed in paragraph 5(d), (e), (f) and (g) who are on duty during each shift.

The number of single bedrooms and shared bedrooms.

The number of bedrooms with en suite facilities.

The number of communal lounge/dining rooms.

The number of bathrooms which have assisted bathing facilities.

Details of any outside space to which the residents have access.

Details of any other facilities to which the residents have access.
