Paragraph (2) applies where any of the following occurs in relation to an application made before this Order comes into force—
a
the application is referred to the Welsh Ministers pursuant to a direction under section 77 of the Town and Country Planning Act 1990, or
b
an appeal is made.

The 2012 Order applies to that application or appeal as though the amendments made by articles 2 to 7 had not been made.
