Mae Gweinidogion Cymru yn gwneud y Gorchymyn hwn drwy arfer—

(a)y pwerau a roddir iddynt gan adrannau 2 a 3 o Ddeddf Iechyd Planhigion 1967(1), ac i’r Gweinidog Amaethyddiaeth, Pysgodfeydd a Bwyd gan adran 4(1) o’r Ddeddf honno, a freinir bellach ynddynt hwy(2); a

(b)y pwerau a roddir gan baragraff 1A o Atodlen 2 i Ddeddf y Cymunedau Ewropeaidd 1972(3).

Mae’r Gorchymyn hwn yn gwneud darpariaeth at ddiben a grybwyllir yn adran 2(2) o Ddeddf y Cymunedau Ewropeaidd 1972(4). Ymddengys i Weinidogion Cymru ei bod yn hwylus i’r cyfeiriadau at offerynnau’r Undeb Ewropeaidd y cyfeirir atynt yn erthygl 2(5) gael eu dehongli fel cyfeiriadau at yr offerynnau hynny fel y’u diwygir o bryd i’w gilydd.

Amnewidiwyd adran 3(4) gan adran 42 o Ddeddf Cyfiawnder Troseddol 1982 (p. 48) ac fe’i diwygiwyd gan Ran 14 o Atodlen 1 i Ddeddf Cyfraith Statud (Diddymiadau) 1993 (p. 50). Diwygiwyd adran 4(1) gan baragraff 8(3) o Atodlen 4 i Ddeddf y Cymunedau Ewropeaidd 1972. Mae’r pwerau a roddir gan adrannau 2 a 3 yn cael eu rhoi i “competent authority” (“awdurdod cymwys”) a ddiffinnir yn adran 1(2). Diwygiwyd adran 1(2) gan baragraff 43 o Atodlen 2 i O.S. 2013/755 (Cy. 90). Mae adran 1(2), fel y’i diwygiwyd, yn darparu mai’r awdurdod cymwys ar gyfer Cymru yw Gweinidogion Cymru.

Trosglwyddwyd swyddogaethau’r Gweinidog Amaethyddiaeth, Pysgodfeydd a Bwyd o dan Ddeddf Iechyd Planhigion 1967, i’r graddau yr oeddent yn arferadwy o ran Cymru, i’r Ysgrifennydd Gwladol gan erthygl 2 o Orchymyn Trosglwyddo Swyddogaethau (Cymru) (Rhif 1) 1978 (O.S. 1978/272) ac Atodlen 1 iddo. Trosglwyddwyd y swyddogaethau hynny o’r Ysgrifennydd Gwladol i Gynulliad Cenedlaethol Cymru gan erthygl 2 o Orchymyn Cynulliad Cenedlaethol Cymru (Trosglwyddo Swyddogaethau) 1999 (O.S. 1999/672) ac Atodlen 1 iddo. Trosglwyddwyd swyddogaethau Cynulliad Cenedlaethol Cymru i Weinidogion Cymru gan adran 162 o Ddeddf Llywodraeth Cymru 2006 (p. 32) a pharagraff 30 o Atodlen 11 iddi.
