NODYN ESBONIADOL

Mae’r Rheoliadau hyn, sy’n gymwys o ran Cymru, yn pennu’r ffioedd sy’n daladwy i Weinidogion Cymru mewn perthynas â gwasanaethau iechyd planhigion ac ardystio tatws hadyd, planhigion ffrwythau a deunydd lluosogi planhigion ffrwythau. Maent yn dirymu ac yn disodli Rheoliadau Ffioedd Iechyd Planhigion (Cymru) 2014 (O.S. 2014/1792 (Cy. 185)).

Mae’r ffioedd a bennir yn rheoliadau 3, 6 a 7 yn daladwy mewn perthynas â mewnforio planhigion, cynhyrchion planhigion a gwrthrychau eraill o drydydd gwledydd yn unol â gofynion Erthygl 13 o Gyfarwyddeb y Cyngor 2000/29/EC ar fesurau gwarchod yn erbyn cyflwyno organeddau sy’n niweidiol i blanhigion neu gynhyrchion planhigion i’r Gymuned ac yn erbyn eu lledaenu o fewn y Gymuned (OJ Rhif L 169, 10.7.2000, t. 1).

Mae’r ffioedd a bennir yn rheoliadau 4 a 5 yn daladwy mewn perthynas ag arolygiadau a gweithgareddau eraill a gynhelir yn unol â Chyfarwyddeb y Cyngor 2000/29/EC.

Mae’r ffioedd a bennir yn rheoliad 8 yn daladwy mewn perthynas ag arolygiadau penodol a gweithgareddau eraill a gynhelir yn unol â Chyfarwyddeb y Cyngor 2002/56/EC ar farchnata tatws hadyd (OJ Rhif L 193, 20.7.2002, t. 60).

Mae’r ffioedd a bennir yn rheoliad 9 yn daladwy mewn perthynas ag arolygiadau penodol a gweithgareddau eraill a gynhelir yn unol â Chyfarwyddeb y Cyngor 2008/90/EC ar farchnata deunydd lluosogi planhigion ffrwythau a phlanhigion ffrwythau a fwriedir ar gyfer cynhyrchu ffrwythau (OJ Rhif L 267, 8.10.2008, t. 8).

Ystyriwyd Cod Ymarfer Gweinidogion Cymru ar gynnal Asesiadau Effaith Rheoleiddiol mewn perthynas â’r Rheoliadau hyn. O ganlyniad, ystyriwyd nad oedd yn angenrheidiol cynnal asesiad effaith rheoleiddiol o’r costau a’r manteision sy’n debygol o ddeillio o gydymffurfio â’r Rheoliadau hyn.
