Mae’r Rheoliadau hyn wedi eu gwneud drwy arfer y pwerau a roddir gan baragraff 1(1) o Atodlen 2 i, Ddeddf yr Undeb Ewropeaidd (Ymadael) 2018 (p .16) er mwyn ymdrin ag unrhyw fethiant yng nghyfraith yr UE a ddargedwir i weithredu’n effeithiol a diffygion eraill sy’n deillio o ymadawiad y Deyrnas Unedig â’r Undeb Ewropeaidd.
Mae’r Rheoliadau hyn yn diwygio Rheoliadau Tir a Halogwyd yn Ymbelydrol (Addasu Deddfiadau) (Cymru) 2006 (“Rheoliadau 2006”). Mae rheoliad 2 yn diwygio rheoliad 5 o Reoliadau 2006 drwy fewnosod darpariaeth newydd sy’n addasu sut y mae’r diffiniad o “inspection” yn Erthygl 4(43) o Gyfarwyddeb y Cyngor 2013/59/Euratom, sy’n gosod safonau diogelwch sylfaenol ar gyfer diogelu rhag y peryglon sy’n codi o ddod i gysylltiad ag ymbelydredd ïoneiddio, ac yn diddymu Cyfarwyddebau 89/618/Euratom, 90/641/Euratom, 96/29/Euratom, 97/43/Euratom a 2003/122/Euratom (OJ Rhif L 013, 17.1.2014, t. 1), i’w ddarllen at ddibenion Rheoliadau 2006.
Ystyriwyd Cod Ymarfer Gweinidogion Cymru ar gynnal Asesiadau Effaith Rheoleiddiol mewn perthynas â’r Rheoliadau hyn. O ganlyniad, ystyriwyd nad oedd yn angenrheidiol cynnal asesiad effaith rheoleiddiol o’r costau a’r manteision sy’n debygol o ddeillio o gydymffurfio â’r Rheoliadau hyn.
