Changes to Legislation

4.—(1) Yn y paragraff hwn, mae “wedi ei llofnodi” yn cynnwys llofnodi gyda llofnod electronig uwch rhagnodydd.
(2) Yn ddarostyngedig i ddarpariaethauʼr Atodlen hon, pan fo—
(a)unrhyw berson yn cyflwyno ffurflen bresgripsiwn anelectronig syʼn cynnwys—
(i)archeb am gyfarpar, nad ywʼn gyfarpar argaeledd cyfyngedig, wedi ei llofnodi gan ragnodydd, neu
(ii)archeb am gyfarpar argaeledd cyfyngedig, wedi ei llofnodi gan ragnodydd ac yn cynnwys y cyfeirnod “SLS”, “Selected List Scheme” neu “Drug Tariff”, neu
(b)contractwr cyfarpar GIG yn cael presgripsiwn amlroddadwy electronig syʼn cydymffurfio âʼr gwasanaeth TPE ac yn cynnwys archeb o fath a bennir ym mharagraff (a)(i) a (ii) ac—
(i)bod unrhyw berson yn gofyn bod cyfarpar yn cael ei ddarparu yn unol âʼr presgripsiwn hwnnw, neu
(ii)bod y contractwr cyfarpar GIG wedi trefnu gydaʼr claf yn flaenorol y byddaiʼn gweinydduʼr presgripsiwn hwnnw pan ddeuai i law,
rhaid iʼr contractwr cyfarpar GIG, yn rhesymol brydlon, ddarparuʼr cyfarpar hwnnw a archebir felly a gyflenwir ganddo yng nghwrs arferol busnes.
(3) At ddibenion y paragraff hwn, mae presgripsiwn amlroddadwy anelectronig am gyfarpar iʼw ystyried fel pe bai wedi ei gyflwyno, hyd yn oed os nad ywʼr person syʼn dymuno cael y cyfarpar yn cyflwynoʼr presgripsiwn hwnnw—
(a)pan fo’r presgripsiwn hwnnw gan y contractwr cyfarpar GIG yn ei feddiant, a
(b)pan fo’r person hwnnw yn cyflwyno swp-ddyroddiad cysylltiedig neu pan fo swp-ddyroddiad cysylltiedig ym meddiant y contractwr cyfarpar GIG.
