Rheoliadau Bwyd Anifeiliaid (Cyfansoddiad, Marchnata a Defnydd) (Cymru) 2016

2.—(1) Mae Rheoliadau Bwyd Anifeiliaid (Cyfansoddiad, Marchnata a Defnydd) (Cymru) 2016(1) wedi eu diwygio fel a ganlyn.

(2) Yn rheoliad 2 (dehongli a chwmpas)—

(a)ym mharagraff (1)—

(i)hepgorer y diffiniad o “Cyfarwyddeb 2008/38”;

(ii)yn y man priodol mewnosoder—

“ystyr “Rheoliad 2020/354” (“Regulation 2020/354”) yw Rheoliad y Comisiwn (EU) 2020/354 sy’n sefydlu rhestr o’r defnydd y bwriedir ei wneud o fwyd anifeiliaid a fwriedir at ddibenion maethol penodol, ac yn diddymu Cyfarwyddeb 2008/38/EC(2);”

(b)yn lle paragraff (3) rhodder—

“(3) Mae unrhyw gyfeiriad yn y Rheoliadau hyn at offeryn UE a ddiffinnir ym mharagraff (1) yn gyfeiriad at yr offeryn UE hwnnw fel y’i diwygir o bryd i’w gilydd.”

(3) Yn lle Rhan 7 (gweithredu Cyfarwyddeb 2008/38) rhodder—

“Rhan 7Gorfodi Rheoliad 2020/354

Dehongli’r Rhan hon

16.  Yn y Rhan hon mae unrhyw gyfeiriad at Erthygl â rhif yn gyfeiriad at yr Erthygl sy’n dwyn y rhif hwnnw yn Rheoliad 2020/354.

Y drosedd o fethu â chydymffurfio ag Erthygl 1 o Reoliad 2020/354

17.  Mae person sy’n mynd yn groes i Erthygl 1 (amodau ar farchnata), fel y’i darllenir gydag Erthygl 2 (rhanddirymiad ar gyfer bwyd anifeiliaid sy’n cydymffurfio â darpariaethau Cyfarwyddeb 2008/38/EC) ac Erthygl 3 (darpariaethau trosiannol ar gyfer bwyd anifeiliaid a labelir cyn 25 Mawrth 2022 yn unol â’r rheolau sy’n gymwys cyn 25 Mawrth 2020), neu sy’n methu â chydymffurfio â hi, yn cyflawni trosedd.”

(4) Yn rheoliad 18 (cosbau am droseddau o dan y Rheoliadau hyn), ym mharagraff (1), yn lle “17(1)” rhodder “17”.

(5) Yn rheoliad 19 (dyletswyddau i orfodi), ar ôl “Rheoliad 767/2009” mewnosoder “, Rheoliad 2020/354”.
