Duty to give a notice E+W

9.—(1) This article applies to a child who on 1 January 2022 has identified special educational needs and who is in a nursery class, year 1, year 3, year 5, year 7 or year 10.

(2) Unless the new law applies in relation to the child, the governing body which provides the special educational provision to the child must either give an IDP notice or a No IDP notice to the child and the child’s parent during the 2021-2022 school year [F1 or the 2022-2023 school year] .
