8.—(1) Rhaid i Awdurdod Parc Cenedlaethol Bannau Brycheiniog (“yr Awdurdod”) benodi deiliad swydd a grybwyllir ym mharagraff (2) yn aelod o CBC y Canolbarth (“aelod Bannau Brycheiniog”).
(2) Y deiliaid swyddi sy’n gymwys i fod yn aelod Bannau Brycheiniog yw—
(a)cadeirydd yr Awdurdod,
(b)dirprwy gadeirydd yr Awdurdod, neu
(c)cadeirydd unrhyw bwyllgor sy’n gyfrifol am faterion cynllunio a all gael ei sefydlu gan yr Awdurdod.
[F1(2A) Ni chaiff aelod Bannau Brycheiniog weithredu fel aelod ond mewn perthynas ag—
(a)y swyddogaethau a roddir i CBC y Canolbarth o dan reoliad 13;
(b)unrhyw swyddogaeth sydd gan CBC y Canolbarth sy’n ategol i’r swyddogaethau hynny neu’n gysylltiedig â hwy.
(2B) Ond caiff aelod Bannau Brycheiniog hefyd weithredu fel aelod mewn perthynas ag unrhyw swyddogaeth arall sydd gan CBC y Canolbarth—
(a)os yw’r aelodau cyngor ac aelod Bannau Brycheiniog yn [F2yn unfrydol], neu
(b)os caniateir i aelod Bannau Brycheiniog weithredu mewn perthynas â’r swyddogaeth honno, neu os yw’n ofynnol iddo wneud hynny, yn rhinwedd darpariaeth ddatganedig yn y Rheoliadau hyn neu mewn unrhyw ddeddfiad arall.
(2C) Rhaid i gytundeb o dan baragraff (2B)(a) bennu’r telerau y caiff aelod Bannau Brycheiniog weithredu odanynt mewn perthynas â’r swyddogaeth o dan sylw, gan gynnwys pennu’r cyfnod pan fo aelod Bannau Brycheiniog i weithredu.]
[F3(3) Pan fo person sy’n aelod Bannau Brycheiniog o dan baragraff (1) (“P”) wedi ei atal dros dro neu pan nad yw’n gallu gweithredu fel aelod Bannau Brycheiniog am unrhyw gyfnod, caiff yr Awdurdod benodi un arall o’r deiliaid swyddi a grybwyllir ym mharagraff (2) i fod yn aelod dirprwyol o CBC y Canolbarth am y cyfnod hwnnw.
(4) At ddibenion y Rheoliadau hyn (ac eithrio’r rheoliad hwn), ac unrhyw ddeddfiad arall, mae aelod dirprwyol a benodir o dan baragraff (3) i’w drin fel pe bai’n aelod Bannau Brycheiniog o CBC y Canolbarth.
(5) Ond nid oes gan yr aelod dirprwyol hawl i bleidleisio, nac i weithredu fel aelod Bannau Brycheiniog fel arall, mewn perthynas â chyflawni unrhyw swyddogaeth sydd gan CBC y Canolbarth y gall P bleidleisio neu weithredu mewn perthynas â hi.
(6) Ym mharagraff (3) ystyr “wedi ei atal dros dro” yw—
(a)wedi ei atal dros dro neu ei atal dros dro yn rhannol o dan Ran 3 o Ddeddf Llywodraeth Leol 2000 rhag bod yn aelod o CBC y Canolbarth, neu
(b)wedi ei atal dros dro yn rhannol o dan Ran 3 o Ddeddf Llywodraeth Leol 2000 rhag bod yn aelod o Awdurdod Parc Cenedlaethol Bannau Brycheiniog.]
