Mae Gweinidogion Cymru yn gwneud y Rheoliadau hyn drwy arfer y pwerau a roddir gan—
Erthyglau 47(2)(b) a 54(4)(a) a (b) o Reoliad (EU) 2017/625 ar reolaethau swyddogol a gweithgareddau swyddogol eraill a gyflawnir i sicrhau y cymhwysir y gyfraith o ran bwyd a bwyd anifeiliaid, rheolau ynghylch iechyd a lles anifeiliaid, iechyd planhigion a chynhyrchion diogelu planhigion(1);
Erthygl 53(1)(b) o Reoliad (EC) Rhif 178/2002 sy’n gosod egwyddorion a gofynion cyffredinol cyfraith bwyd, yn sefydlu Awdurdod Diogelwch Bwyd Ewrop ac yn gosod gweithdrefnau o ran materion diogelwch bwyd(2).
Fel sy’n ofynnol gan Erthygl 144(7) o Reoliad (EU) 2017/625, cyn gwneud y Rheoliadau hyn mae Gweinidogion Cymru wedi ymgynghori â’r cyrff a’r personau hynny yr ymddengys i Weinidogion Cymru eu bod yn cynrychioli buddiannau y mae’n debygol y bydd y Rheoliadau hyn yn effeithio arnynt yn sylweddol ac unrhyw gyrff neu bersonau eraill y mae Gweinidogion Cymru yn ystyried eu bod yn briodol.
Fel sy’n ofynnol gan Erthygl 9 o Reoliad (EC) Rhif 178/2002, ymgynghorwyd yn agored ac yn dryloyw â’r cyhoedd wrth lunio a gwerthuso’r Rheoliadau hyn.
1.—(1) Enw’r Rheoliadau hyn yw Rheoliadau Rheolaethau Swyddogol (Mewnforio Bwyd a Bwyd Anifeiliaid Risg Uchel Nad Ydynt yn Dod o Anifeiliaid) (Diwygio Rheoliad Gweithredu’r Comisiwn (EU) 2019/1793) (Cymru) 2022.
(2) Mae’r Rheoliadau hyn—
(a)yn rhychwantu Cymru a Lloegr;
(b)yn gymwys o ran Cymru;
(c)yn dod i rym ar 17 Ionawr 2023.
2.—(1) Mae Rheoliad Gweithredu’r Comisiwn (EU) 2019/1793 ar gynyddu dros dro reolaethau swyddogol a mesurau brys sy’n rheoli mynediad i’r Undeb i nwyddau penodol o drydydd gwledydd penodol(3) wedi ei ddiwygio fel a ganlyn.
(2) Yn lle Atodiad 1, rhodder yr Atodiad 1 a geir yn Atodlen 1 i’r Rheoliadau hyn.

(4) The analytical report referred to in Article 10(3) of this Regulation must be issued by a laboratory accredited for the analysis of PCP in food and feed in accordance with BS EN ISO/IEC 17025:2017 “General requirements for the competence of testing and calibration laboratories” (published by the British Standards Institution on 30 June 2018 (ISBN 978 0 539 01414 3), and available from the British Standards Institution at https://knowledge.bsigroup.com). The analytical report must indicate: (a) the results of sampling and analysis for the presence of PCP, performed by the competent authorities of the country of origin or of the country where the consignment is consigned from if that country is different from the country of origin; (b) the measurement uncertainty of the analytical result; (c) the limit of detection (LOD) of the analytical method; (d) the limit of quantification (LOQ) of the analytical method. The extraction before analysis must be performed with an acidified solvent. The analysis must be carried out according to the modified version of the QuEChERS method or according to an equally reliable method. The modified version of the QuEChERS method is set out in the document “Analytical Quality Control and Method Validation Procedures for Pesticide Residues Analysis in Food and Feed” (SANTE 2017/11813), implemented on 1 January 2020 and available at https://www.eurl-pesticides.eu/userfiles/file/EurlALL/AqcGuidance_SANTE_2019_12682.pdf. | |||||

Mae’r Rheoliadau hyn yn diwygio, o ran Cymru, Reoliad Gweithredu’r Comisiwn (EU) 2019/1793 ar gynyddu dros dro reolaethau swyddogol a mesurau brys sy’n rheoli mynediad i’r Undeb i nwyddau penodol o drydydd gwledydd penodol (“Rheoliad 2019/1793”).
Mae rheoliad 2 yn amnewid, gyda diwygiadau, Atodiadau 1, 2 a 2a i Reoliad 2019/1793. Amnewidir Atodiad 1 drwy ddefnyddio pwerau yn Erthyglau 47(2)(b) a 54(4)(a) o Reoliad (EU) 2017/625 ar reolaethau swyddogol a gweithgareddau swyddogol eraill a gyflawnir i sicrhau y cymhwysir y gyfraith o ran bwyd a bwyd anifeiliaid, rheolau ynghylch iechyd a lles anifeiliaid, iechyd planhigion a chynhyrchion diogelu planhigion. Amnewidir Atodiadau 2 a 2a drwy ddefnyddio pwerau yn Erthygl 53 o Reoliad (EC) Rhif 178/2002 sy’n gosod egwyddorion a gofynion cyffredinol cyfraith bwyd, yn sefydlu Awdurdod Diogelwch Bwyd Ewrop ac yn gosod gweithdrefnau o ran materion diogelwch bwyd ac Erthygl 54(4)(b) o Reoliad (EU) 2017/625.

Mae’r cofnod ar gyfer cnau cyll a chynhyrchion cysylltiedig o Dwrci (ar gyfer afflatocsinau) wedi ei ddileu (mae’r cofnod wedi ei drosglwyddo i Atodiad 1).
Mae amlder y gwiriadau ar ddail gwinwydd o Dwrci (ar gyfer gweddillion plaleiddiaid) wedi ei gynyddu o 20% i 50%.
Mae Atodiad 2, Tabl 2, yn cynnwys rhestr o fwyd cyfansawdd sy’n cynnwys unrhyw fwyd a restrir yn Nhabl 1 yn Atodiad 2 oherwydd y risg o halogi gan afflatocsinau mewn swm sy’n fwy nag 20% o naill ai cynnyrch unigol neu swm y cynhyrchion hynny. Y newid a wneir i Dabl 2 yn Atodiad 2 yw ychwanegu cofnod newydd ar gyfer cymysgeddau o sbeisys.
Mae Atodiad 2a yn cynnwys y rhestr o fwyd a bwyd anifeiliaid nad ydynt yn dod o anifeiliaid sydd wedi eu gwahardd rhag dod i Brydain Fawr. Mae’r cofnod yn Atodiad 2a ar gyfer bwyd sy’n cynnwys, neu fwyd sydd ar ffurf, dail betel ( Piper betle) o Fangladesh (ar gyfer Salmonela) wedi ei ddileu (ond gweler y cofnod newydd ar gyfer hyn yn Atodiad 2, Tabl 1).
Ystyriwyd Cod Ymarfer Gweinidogion Cymru ar gynnal Asesiadau Effaith Rheoleiddiol mewn perthynas â’r Rheoliadau hyn. O ganlyniad, ystyriwyd nad oedd yn angenrheidiol cynnal asesiad effaith rheoleiddiol o’r costau a’r manteision sy’n debygol o ddeillio o gydymffurfio â’r Rheoliadau hyn.
