Rheoliadau Cyd-bwyllgor Corfforedig y Canolbarth (Cymru) 2021
5.—(1) Mae Rheoliadau Cyd-bwyllgor Corfforedig y Canolbarth (Cymru) 2021(1) wedi eu diwygio fel a ganlyn.
(2) Yn rheoliad 7 (aelodau cyngor) yn lle paragraff (2) rhodder—
“(2) Pan fo person sy’n aelod cyngor o dan baragraff (1) (“P”) wedi ei atal dros dro neu pan nad yw’n gallu gweithredu fel aelod cyngor am unrhyw gyfnod, caiff y cyngor cyfansoddol y mae P yn aelod ohono benodi aelod o’i weithrediaeth i fod yn aelod dirprwyol o CBC y Canolbarth am y cyfnod hwnnw.
(2A) At ddibenion y Rheoliadau hyn (ac eithrio’r rheoliad hwn), ac unrhyw ddeddfiad arall, mae aelod dirprwyol a benodir o dan baragraff (2) i’w drin fel pe bai’n aelod cyngor o CBC y Canolbarth.
(2B) Ond nid oes gan yr aelod dirprwyol hawl i bleidleisio, nac i weithredu fel aelod cyngor fel arall, mewn perthynas â chyflawni unrhyw swyddogaeth sydd gan CBC y Canolbarth y gall P bleidleisio neu weithredu mewn perthynas â hi.
(2C) Ym mharagraff (2) ystyr “wedi ei atal dros dro” yw—
(a)wedi ei atal dros dro neu ei atal dros dro yn rhannol o dan Ran 3 o Ddeddf Llywodraeth Leol 2000 rhag bod yn aelod o CBC y Canolbarth, neu
(b)wedi ei atal dros dro yn rhannol o dan Ran 3 o Ddeddf Llywodraeth Leol 2000 rhag bod yn aelod o’r cyngor cyfansoddol y mae P hefyd yn aelod ohono.”
(3) Yn rheoliad 8 (aelod Bannau Brycheiniog), yn lle paragraff (3) rhodder—
“(3) Pan fo person sy’n aelod Bannau Brycheiniog o dan baragraff (1) (“P”) wedi ei atal dros dro neu pan nad yw’n gallu gweithredu fel aelod Bannau Brycheiniog am unrhyw gyfnod, caiff yr Awdurdod benodi un arall o’r deiliaid swyddi a grybwyllir ym mharagraff (2) i fod yn aelod dirprwyol o CBC y Canolbarth am y cyfnod hwnnw.
(4) At ddibenion y Rheoliadau hyn (ac eithrio’r rheoliad hwn), ac unrhyw ddeddfiad arall, mae aelod dirprwyol a benodir o dan baragraff (3) i’w drin fel pe bai’n aelod Bannau Brycheiniog o CBC y Canolbarth.
(5) Ond nid oes gan yr aelod dirprwyol hawl i bleidleisio, nac i weithredu fel aelod Bannau Brycheiniog fel arall, mewn perthynas â chyflawni unrhyw swyddogaeth sydd gan CBC y Canolbarth y gall P bleidleisio neu weithredu mewn perthynas â hi.
(6) Ym mharagraff (3) ystyr “wedi ei atal dros dro” yw—
(a)wedi ei atal dros dro neu ei atal dros dro yn rhannol o dan Ran 3 o Ddeddf Llywodraeth Leol 2000 rhag bod yn aelod o CBC y Canolbarth, neu
(b)wedi ei atal dros dro yn rhannol o dan Ran 3 o Ddeddf Llywodraeth Leol 2000 rhag bod yn aelod o Awdurdod Parc Cenedlaethol Bannau Brycheiniog.”
