The Welsh Ministers, in exercise of the powers conferred by section 146(4)(b) of the Social Services and Well-being (Wales) Act 2014(1), make the following Order.

Title and interpretation

1.—(1) The title of this Order is the Revised Code of Practice on the exercise of social services functions in relation to Part 4 (direct payments and choice of accommodation) and Part 5 (charging and financial assessment) of the Social Services and Well-being (Wales) Act 2014 (Appointed Day) Order 2022.

(2) In this Order, “the Revised Code” means the Code of Practice on the exercise of social services functions in relation to Part 4 (direct payments and choice of accommodation) and Part 5 (charging and financial assessment) of the Social Services and Well-being (Wales) Act 2014, a draft of which was laid, in accordance with section 146(2) of that Act, before Senedd Cymru on 4 February 2022 and was issued by the Welsh Ministers on 4 April 2022.

2.  The day appointed for the coming into force of the Revised Code is 11 April 2022

EXPLANATORY NOTE

(This note is not part of the Order)

This Order appoints 11 April 2022 as the day on which the revised Code of Practice on the exercise of social services functions in relation to Part 4 (direct payments and choice of accommodation) and Part 5 (charging and financial assessment) of the Social Services and Well-being (Wales) Act 2014 comes into force. This revised Code was issued by the Welsh Ministers under section 145(1) of the Social Services and Well-being (Wales) Act 2014 (“the 2014 Act”) on 4 April 2022.

Section 145(3) of the 2014 Act requires local authorities to act in accordance with any relevant requirements contained in a code issued under section 145(1) and to have regard to any relevant guidelines contained in it.

The revised Code includes changes brought about by the Care and Support (Charging) and (Financial Assessment) (Wales) (Miscellaneous Amendments) Regulations 2022 (S.I. 2022/99 (W. 35)).
