The analytical report referred to in Article 10(3) of this Regulation must be issued by a laboratory accredited for the analysis of PCP in food and feed in accordance with BS EN ISO/IEC 17025:2017 “General requirements for the competence of testing and calibration laboratories” (published by the British Standards Institution on 30 June 2018 (ISBN 978 0 539 01414 3), and available from the British Standards Institution at https://knowledge.bsigroup.com). The analytical report must indicate: (a) the results of sampling and analysis for the presence of PCP, performed by the competent authorities of the country of origin or of the country where the consignment is consigned from if that country is different from the country of origin; (b) the measurement uncertainty of the analytical result; (c) the limit of detection (LOD) of the analytical method; (d) the limit of quantification (LOQ) of the analytical method. The extraction before analysis must be performed with an acidified solvent. The analysis must be carried out according to the modified version of the QuEChERS method or according to an equally reliable method. The modified version of the QuEChERS method is set out in the document “Analytical Quality Control and Method Validation Procedures for Pesticide Residues Analysis in Food and Feed” (SANTE 2017/11813), implemented on 1 January 2020 and available at https://www.eurl-pesticides.eu/userfiles/file/EurlALL/AqcGuidance_SANTE_2019_12682.pdf.

Mae’r Rheoliadau hyn yn diwygio, o ran Cymru, Reoliad Gweithredu’r Comisiwn (EU) 2019/1793 ar gynyddu dros dro reolaethau swyddogol a mesurau brys sy’n rheoli mynediad i’r Undeb i nwyddau penodol o drydydd gwledydd penodol (EUR 2019/1793).

Mae rheoliad 2 yn gwneud darpariaeth i ddiweddaru’r rhestrau o fwyd a bwyd anifeiliaid risg uchel nad ydynt yn dod o anifeiliaid yn Atodiadau 1 a 2 i EUR 2019/1793. Mae rheoliad 2(4) a (5), ac Atodlenni 1 a 2, yn amnewid yr Atodiadau hynny. Mae rheoliad 3 yn gwneud diwygiadau canlyniadol i Reoliadau Rheolaethau Swyddogol (Mewnforio Bwyd a Bwyd Anifeiliaid Risg Uchel Nad Ydynt yn Dod o Anifeiliaid) (Diwygio Rheoliad Gweithredu’r Comisiwn (EU) 2019/1793) (Cymru) 2022 (O.S. 2022/1330 (Cy. 269), i ddileu diwygiadau cynharach i EUR 2019/1793 a ddisodlir gan y diwygiadau a wneir gan y Rheoliadau hyn.

Mae Atodiad 1 i EUR 2019/1793 yn cynnwys y rhestr o fwyd a bwyd anifeiliaid nad ydynt yn dod o anifeiliaid sy’n ddarostyngedig i gynnydd dros dro mewn rheolaethau swyddogol mewn safleoedd rheoli ar y ffin neu mewn safleoedd rheoli ym Mhrydain Fawr.   • Cofnod newydd ar gyfer pitahaya (ffrwyth y ddraig) o Fietnam (ar gyfer gweddillion plaleiddiaid). Mae amlder y gwiriadau wedi ei ragnodi ar 50%. Trosglwyddir y cofnod i Atodiad 1 (o Atodiad 2, Tabl 1) gyda chynnydd yn amlder y gwiriadau (o 10%).

Yn Atodiad 2 i EUR 2019/1793, mae Tabl 1 yn cynnwys y rhestr o fwyd a bwyd anifeiliaid nad ydynt yn dod o anifeiliaid y mae amodau arbennig wedi eu rhagnodi ar eu cyfer sy’n rheoli eu mynediad i Brydain Fawr. Mae’r newidiadau a wneir i Atodiad 2, Tabl 1, fel a ganlyn.

  • Cofnod newydd ar gyfer madarch enoki o Tsieina (ar gyfer Listeria). Mae amlder y gwiriadau wedi ei ragnodi ar 20%.

  • Cofnod newydd ar gyfer past cnau daear o’r Aifft (ar gyfer afflatocsinau). Mae amlder y gwiriadau wedi ei ragnodi ar 20%.

  • Cofnod newydd ar gyfer dail gwinwydd o’r Aifft (ar gyfer gweddillion plaleiddiaid). Mae amlder y gwiriadau wedi ei ragnodi ar 20%.

  • Cofnod newydd ar gyfer past cnau daear o Ghana (ar gyfer afflatocsinau). Mae amlder y gwiriadau wedi ei ragnodi ar 50%.

  • Cofnod newydd ar gyfer past cnau daear o’r Gambia (ar gyfer afflatocsinau). Mae amlder y gwiriadau wedi ei ragnodi ar 50%.

  • Mae amlder y gwiriadau ar nytmeg (Myristica fragrans) o Indonesia (ar gyfer afflatocsinau) wedi ei leihau i 10% (o 20%).

  • Cofnod newydd ar gyfer past cnau daear o India (ar gyfer afflatocsinau). Mae amlder y gwiriadau wedi ei ragnodi ar 50%.

  • Cofnod newydd ar gyfer pupurau o’r genws Capsicum (pupurau melys neu bupurau heblaw pupurau melys) (bwyd – wedi eu sychu, eu rhostio, eu gwasgu neu eu malu) o India (ar gyfer gweddillion plaleiddiaid). Mae amlder y gwiriadau wedi ei ragnodi ar 20%.

  • Mae amlder y gwiriadau ar bupurau o’r genws Capsicum (ac eithrio pupurau melys) (bwyd – ffres, wedi eu hoeri neu wedi eu rhewi) o India (ar gyfer gweddillion plaleiddiaid) wedi ei gynyddu i 20% (o 10%).

  • Cofnod newydd ar gyfer madarch enoki o Dde Korea (ar gyfer Listeria). Mae amlder y gwiriadau wedi ei ragnodi ar 20%.

  • Cofnod newydd ar gyfer cymysgeddau sbeis o Bacistan (ar gyfer afflatocsinau). Mae amlder y gwiriadau wedi ei ragnodi ar 10%. Trosglwyddir y cofnod i Atodiad 2, Tabl 1 (o Atodiad 1) gyda lleihad i amlder y gwiriadau (o 50%).

  • Cofnod newydd ar gyfer past cnau daear o Sudan (ar gyfer afflatocsinau). Mae amlder y gwiriadau wedi ei ragnodi ar 50%.

  • Mae’r cofnod ar gyfer pitahaya (ffrwyth y ddraig) o Fietnam (ar gyfer gweddillion plaleiddiaid) wedi ei ddileu. Trosglwyddir y cofnod i Atodiad 1 gyda chynnydd yn amlder y gwiriadau (o 10% i 50%).

Yn Atodiad 2 i EUR 2019/1793, mae Tabl 2 yn cynnwys rhestr o fwyd cyfansawdd sy’n cynnwys unrhyw fwyd a restrir yn Nhabl 1 yn Atodiad 2 oherwydd y risg o halogi gan afflatocsinau mewn swm sy’n fwy na 20% o naill ai cynnyrch unigol neu swm y cynhyrchion hynny. Mae Tabl 2 yn cael ei ailddatgan heb unrhyw newidiadau.

Mae Atodiad 2a i EUR 2019/1793 yn cynnwys y rhestr o fwyd a bwyd anifeiliaid nad ydynt yn dod o anifeiliaid sydd wedi eu gwahardd rhag dod i Brydain Fawr. Nid oes unrhyw newidiadau yn cael eu gwneud i Atodiad 2a.

Ystyriwyd Cod Ymarfer Gweinidogion Cymru ar gynnal Asesiadau Effaith Rheoleiddiol mewn perthynas â’r Rheoliadau hyn. O ganlyniad, ystyriwyd nad oedd yn angenrheidiol cynnal asesiad effaith rheoleiddiol o’r costau a’r manteision sy’n debygol o ddeillio o gydymffurfio â’r Rheoliadau hyn.
