The analytical report must indicate: (a) the results of sampling and analysis for the presence of PCP, performed by the competent authorities of the country of origin or of the country where the consignment is consigned from if that country is different from the country of origin; (b) the measurement uncertainty of the analytical result; (c) the limit of detection (LOD) of the analytical method; (d) the limit of quantification (LOQ) of the analytical method. The extraction before analysis must be performed with an acidified solvent. The analysis must be carried out according to the modified version of the QuEChERS method or according to an equally reliable method. Mae’r Rheoliadau hyn yn diwygio, o ran Cymru, Reoliad Gweithredu’r Comisiwn (EU) 2019/1793 ar gynyddu dros dro reolaethau swyddogol a mesurau brys sy’n rheoli mynediad i’r Undeb i nwyddau penodol o drydydd gwledydd penodol (EUR 2019/1793).

Mae rheoliad 2 yn gwneud darpariaeth i ddiweddaru’r rhestrau o fwyd a bwyd anifeiliaid risg uchel nad ydynt yn dod o anifeiliaid yn Atodiadau 1 a 2 i EUR 2019/1793. Mae rheoliad 2(4) a (5), ac Atodlenni 1 a 2, yn amnewid yr Atodiadau hynny. Amnewidir Atodiad 1 drwy ddefnyddio pwerau yn Erthyglau 47(2)(b) a 54(4)(a) o Reoliad (EU) 2017/625 Senedd Ewrop a’r Cyngor ar reolaethau swyddogol a gweithgareddau swyddogol eraill a gyflawnir i sicrhau y cymhwysir y gyfraith o ran bwyd a bwyd anifeiliaid, rheolau ynghylch iechyd a lles anifeiliaid, iechyd planhigion a chynhyrchion diogelu planhigion (EUR 2017/625). Amnewidir Atodiad 2 drwy ddefnyddio pwerau yn Erthygl 53 o Reoliad (EC) Rhif 178/2002 Senedd Ewrop a’r Cyngor sy’n gosod egwyddorion a gofynion cyffredinol cyfraith bwyd, yn sefydlu Awdurdod Diogelwch Bwyd Ewrop ac yn gosod gweithdrefnau o ran materion diogelwch bwyd (EUR 2002/178) ac Erthygl 54(4)(b) o EUR 2017/625.

Mae rheoliad 2(2), (3) a (6), ac Atodlen 3, yn diwygio EUR 2019/1793 i wneud darpariaeth mewn perthynas â samplu a dadansoddi ar gyfer y perygl Listeria. Nodir y weithdrefn samplu ragnodedig a’r dull cyfeirio dadansoddol rhagnodedig ar gyfer rheoli presenoldeb Listeria mewn bwyd yn yr Atodiad 3a newydd i EUR 2019/1793 (a fewnosodir gan reoliad 2(6) ac Atodlen 3).

Mae rheoliad 3 yn gwneud diwygiadau canlyniadol i Reoliadau Rheolaethau Swyddogol (Mewnforio Bwyd a Bwyd Anifeiliaid Risg Uchel Nad Ydynt yn Dod o Anifeiliaid) (Diwygio Rheoliad Gweithredu’r Comisiwn (EU) 2019/1793) (Cymru) 2022 (O.S. 2022/1330 (Cy. 269), i ddileu diwygiadau cynharach i EUR 2019/1793 a ddisodlir gan y diwygiadau a wneir gan y Rheoliadau hyn.

Mae Atodiad 1 i EUR 2019/1793 yn cynnwys y rhestr o fwyd a bwyd anifeiliaid nad ydynt yn dod o anifeiliaid sy’n ddarostyngedig i gynnydd dros dro mewn rheolaethau swyddogol mewn safleoedd rheoli ar y ffin neu mewn safleoedd rheoli ym Mhrydain Fawr. Mae’r newidiadau a wneir i Atodiad 1 fel a ganlyn.

Cofnod newydd ar gyfer past cnau daear o Bolivia (ar gyfer afflatocsinau). Mae amlder y gwiriadau wedi ei ragnodi ar 50%.
Mae’r cofnodion ar gyfer cnau daear (pysgnau) a chynhyrchion cysylltiedig, o Frasil, (ar gyfer afflatocsinau) wedi eu dileu.
Cywiriad i gyfeirnod troednodyn y tabl yn y cofnod ar gyfer cnau daear (pysgnau) a chynhyrchion cysylltiedig, o Frasil (ar gyfer gweddillion plaleiddiaid).
Cofnod newydd ar gyfer past cnau daear o Frasil (ar gyfer gweddillion plaleiddiaid). Mae amlder y gwiriadau wedi ei ragnodi ar 20%.
Cofnod newydd ar gyfer past cnau daear o Tsieina (ar gyfer afflatocsinau). Mae amlder y gwiriadau wedi ei ragnodi ar 10%.
Mae amlder y gwiriadau ar bupurau melys (Capsicum annum) o Tsieina (ar gyfer Salmonella) wedi ei leihau i 10% (o 20%).
Cofnod newydd ar gyfer granadila (Passiflora ligularis) a ffrwyth y dioddefaint (Passiflora edulis) o Colombia (ar gyfer gweddillion plaleiddiaid). Mae amlder y gwiriadau wedi ei ragnodi ar 10%.
Cywiriad i’r cofnod ar gyfer ffa llathen o Weriniaeth Dominica (ar gyfer gweddillion plaleiddiaid).
Cofnod newydd ar gyfer bananas o Ecuador (ar gyfer gweddillion plaleiddiaid). Mae amlder y gwiriadau wedi ei ragnodi ar 5%.
Cofnod newydd ar gyfer orenau o’r Aifft (ar gyfer gweddillion plaleiddiaid). Mae amlder y gwiriadau wedi ei ragnodi ar 10%.
Mae amlder y gwiriadau ar olew palmwydd o Ghana (ar gyfer llifynnau Sudan) wedi ei ostwng i 20% (o 50%).
Cofnod newydd ar gyfer sinamon a blodau coed sinamon o India (ar gyfer gweddillion plaleiddiaid). Mae amlder y gwiriadau wedi ei ragnodi ar 10%.
Cofnod newydd ar gyfer clofs (ffrwythau cyfan, ewinedd a choesynnau) o India (ar gyfer gweddillion plaleiddiaid). Mae amlder y gwiriadau wedi ei ragnodi ar 10%.
Cofnod newydd ar gyfer drymffyn (Moringa oleifera) o India (ar gyfer gweddillion plaleiddiaid). Mae amlder y gwiriadau wedi ei ragnodi ar 20%.
Cofnod newydd ar gyfer sinsir, saffrwm, tyrmerig (Curcuma), teim, dail llawryf, cyrri a sbeisys eraill, o India (ar gyfer gweddillion plaleiddiaid). Mae amlder y gwiriadau wedi ei ragnodi ar 10%.
Cofnod newydd ar gyfer nytmeg, mas a chardamoms o India (ar gyfer gweddillion plaleiddiaid). Mae amlder y gwiriadau wedi ei ragnodi ar 10%.
Cofnodion newydd ar gyfer reis o India (ar gyfer afflatocsinau ac ocratocsin A, ac ar gyfer gweddillion plaleiddiaid). Mae amlderau’r gwiriadau ar gyfer afflatocsinau ac ocratocsin A, ac ar gyfer gweddillion plaleiddiaid wedi eu rhagnodi ar 5%.
Cofnod newydd ar gyfer hadau anis, badian, ffenigl, coriander, cwmin neu garwe, ac ar gyfer aeron meryw, o India (ar gyfer gweddillion plaleiddiaid). Mae amlder y gwiriadau wedi ei ragnodi ar 10%.
Cofnod newydd ar gyfer hadau melon o Iran (ar gyfer afflatocsinau). Mae amlder y gwiriadau wedi ei ragnodi ar 10%.
Cofnod newydd ar gyfer pupurau o’r genws Capsicum (ac eithrio pupurau melys) o Kenya (ar gyfer gweddillion plaleiddiaid). Mae amlder y gwiriadau wedi ei ragnodi ar 10%.
Cywiriad i’r cofnod ar gyfer ffa llathen o Cambodia (ar gyfer gweddillion plaleiddiaid).
Cofnod newydd ar gyfer ffa llygatddu (Vigna unguiculata subspp.) o Madagascar (ar gyfer gweddillion plaleiddiaid). Mae amlder y gwiriadau wedi ei ragnodi ar 10%.
Cofnodion newydd ar gyfer reis o Bacistan (ar gyfer afflatocsinau ac ocratocsin A, ac ar gyfer gweddillion plaleiddiaid). Mae amlderau’r gwiriadau ar gyfer afflatocsinau ac ocratocsin A, ac ar gyfer gweddillion plaleiddiaid wedi eu rhagnodi ar 5%.
Mae’r cofnod ar gyfer cymysgeddau sbeis o Bacistan (ar gyfer afflatocsinau) wedi ei ddileu. Trosglwyddir y cofnod i Atodiad 2, Tabl 1 gyda lleihad i amlder y gwiriadau (o 50% i 10%).
Cofnod newydd ar gyfer past cnau daear o Senegal (ar gyfer afflatocsinau). Mae amlder y gwiriadau wedi ei ragnodi ar 50%.
Cofnod newydd ar gyfer hadau Sesamum o Syria. Mae amlder y gwiriadau wedi ei ragnodi ar 10%.
Cofnod newydd ar gyfer tahini a halfa o hadau Sesamum, o Syria. Mae amlder y gwiriadau wedi ei ragnodi ar 10%.
Mae amlder y gwiriadau ar gyfer pupurau o’r genws Capsicum (ac eithrio pupurau melys) o Wlad Thai wedi ei gynyddu i 50% (o 20%).
Mae’r cofnodion ar gyfer cnau cyll (Corylus spp.) a chynhyrchion cysylltiedig, o Türkiye, (ar gyfer afflatocsinau) wedi eu dileu.
Cofnod newydd ar gyfer past cnau daear o’r Unol Daleithiau (ar gyfer afflatocsinau). Mae amlder y gwiriadau wedi ei ragnodi ar 10%.
Cofnod newydd ar gyfer pitahaya (ffrwyth y ddraig) o Fietnam (ar gyfer gweddillion plaleiddiaid). Mae amlder y gwiriadau wedi ei ragnodi ar 50%. Trosglwyddir y cofnod i Atodiad 1 (o Atodiad 2, Tabl 1) gyda chynnydd yn amlder y gwiriadau (o 10%).

Yn Atodiad 2 i EUR 2019/1793, mae Tabl 1 yn cynnwys y rhestr o fwyd a bwyd anifeiliaid nad ydynt yn dod o anifeiliaid y mae amodau arbennig wedi eu rhagnodi ar eu cyfer sy’n rheoli eu mynediad i Brydain Fawr. Mae’r newidiadau a wneir i Atodiad 2, Tabl 1, fel a ganlyn.

Cofnod newydd ar gyfer madarch enoki o Tsieina (ar gyfer Listeria). Mae amlder y gwiriadau wedi ei ragnodi ar 20%.
Cofnod newydd ar gyfer past cnau daear o’r Aifft (ar gyfer afflatocsinau). Mae amlder y gwiriadau wedi ei ragnodi ar 20%.
Cofnod newydd ar gyfer dail gwinwydd o’r Aifft (ar gyfer gweddillion plaleiddiaid). Mae amlder y gwiriadau wedi ei ragnodi ar 20%.
Cofnod newydd ar gyfer past cnau daear o Ghana (ar gyfer afflatocsinau). Mae amlder y gwiriadau wedi ei ragnodi ar 50%.
Cofnod newydd ar gyfer past cnau daear o’r Gambia (ar gyfer afflatocsinau). Mae amlder y gwiriadau wedi ei ragnodi ar 50%.
Mae amlder y gwiriadau ar nytmeg (Myristica fragrans) o Indonesia (ar gyfer afflatocsinau) wedi ei leihau i 10% (o 20%).
Cofnod newydd ar gyfer past cnau daear o India (ar gyfer afflatocsinau). Mae amlder y gwiriadau wedi ei ragnodi ar 50%.
Cofnod newydd ar gyfer pupurau o’r genws Capsicum (pupurau melys neu bupurau heblaw pupurau melys) (bwyd – wedi eu sychu, eu rhostio, eu gwasgu neu eu malu) o India (ar gyfer gweddillion plaleiddiaid). Mae amlder y gwiriadau wedi ei ragnodi ar 20%.
Mae amlder y gwiriadau ar bupurau o’r genws Capsicum (ac eithrio pupurau melys) (bwyd – ffres, wedi eu hoeri neu wedi eu rhewi) o India (ar gyfer gweddillion plaleiddiaid) wedi ei gynyddu i 20% (o 10%).
Cofnod newydd ar gyfer madarch enoki o Dde Korea (ar gyfer Listeria). Mae amlder y gwiriadau wedi ei ragnodi ar 20%.
Cofnod newydd ar gyfer cymysgeddau sbeis o Bacistan (ar gyfer afflatocsinau). Mae amlder y gwiriadau wedi ei ragnodi ar 10%. Trosglwyddir y cofnod i Atodiad 2, Tabl 1 (o Atodiad 1) gyda lleihad i amlder y gwiriadau (o 50%).
Cofnod newydd ar gyfer past cnau daear o Sudan (ar gyfer afflatocsinau). Mae amlder y gwiriadau wedi ei ragnodi ar 50%.
Mae’r cofnod ar gyfer pitahaya (ffrwyth y ddraig) o Fietnam (ar gyfer gweddillion plaleiddiaid) wedi ei ddileu. Trosglwyddir y cofnod i Atodiad 1 gyda chynnydd yn amlder y gwiriadau (o 10% i 50%).

Yn Atodiad 2 i EUR 2019/1793, mae Tabl 2 yn cynnwys rhestr o fwyd cyfansawdd sy’n cynnwys unrhyw fwyd a restrir yn Nhabl 1 yn Atodiad 2 oherwydd y risg o halogi gan afflatocsinau mewn swm sy’n fwy na 20% o naill ai cynnyrch unigol neu swm y cynhyrchion hynny. Mae Tabl 2 yn cael ei ailddatgan heb unrhyw newidiadau.

Mae Atodiad 2a i EUR 2019/1793 yn cynnwys y rhestr o fwyd a bwyd anifeiliaid nad ydynt yn dod o anifeiliaid sydd wedi eu gwahardd rhag dod i Brydain Fawr. Nid oes unrhyw newidiadau yn cael eu gwneud i Atodiad 2a.

Ystyriwyd Cod Ymarfer Gweinidogion Cymru ar gynnal Asesiadau Effaith Rheoleiddiol mewn perthynas â’r Rheoliadau hyn. O ganlyniad, ystyriwyd nad oedd yn angenrheidiol cynnal asesiad effaith rheoleiddiol o’r costau a’r manteision sy’n debygol o ddeillio o gydymffurfio â’r Rheoliadau hyn.
