The Office of the First Minister and deputy First Minister makes the following Order in exercise of the powers conferred by section 28(2) of the Commissioner for Older People Act (Northern Ireland) 2011(1).
1.—(1) This Order may be cited as the Commissioner for Older People Act 2011 (Commencement) Order (Northern Ireland) 2012.
(2) In this Order—
“the Act” means the Commissioner for Older People Act (Northern Ireland) 2011.
2. The appointed day for the coming into operation of the following sections of the Act is 1st December 2012—
(a)Section 2 (Principal aim of the Commissioner).
(b)Section 3 (Duties of the Commissioner).
(c)Section 4 (General powers of the Commissioner).
(d)Section 5 (General review of advocacy, complaint, inspection and whistle-blowing arrangements of relevant authorities).
(e)Section 6 (Review of advocacy, complaint, inspection and whistle-blowing arrangements of relevant authorities in individual cases).
(f)Section 7 (Assistance with complaints to relevant authorities).
(g)Section 8 (Investigation of complaints against relevant authorities).
(h)Section 9 (Actions which may be investigated: restrictions and exclusions).
(i)Section 10 (Power to bring, intervene in or assist in legal proceedings).
(j)Section 11 (Assistance in relation to legal proceedings).
(k)Section 12 (Conciliation of disputes).
(l)Section 13 (Formal investigations).
(m)Section 14 (Formal investigations: exclusions).
(n)Section 15 (Report on formal investigation).
(o)Section 16 (Further action following report on formal investigation).
(p)Section 17 (Evidence in formal investigations).
(q)Section 18 (Powers of entry and inspection for purposes of formal investigation).
(r)Section 19 (Obstruction and contempt in relation to formal investigation).
(s)Section 20 (Disclosure of information by Commissioner).
(t)Section 21 (Review of this Act).
(u)Section 22 (Privilege for certain publications).
(v)Section 23 (Application of this Act: relevant authorities with mixed functions).
(w)Section 24 (Application of this Act: matters arising before commencement).
(x)Schedule 2 (Investigation under Section 4(4)).

This Commencement Order brings the powers, duties and responsibilities of the Commissioner for Older People as set out in the Commissioner for Older People Act (Northern Ireland) 2011 into force. Sections 2 to 24 and Schedule 2 are brought into operation.
