The Local Government in Scotland Act 2003 (Commencement No. 4) Order 2009

The Scottish Ministers make the following Order in exercise of the powers conferred by section 62(2) of the Local Government in Scotland Act 2003(1) and of all other powers enabling them to do so.

Citation

1.  This Order may be cited as the Local Government in Scotland Act 2003 (Commencement No. 4) Order 2009.

Commencement

2.  Section 40 of the Local Government in Scotland Act 2003 (power of local authorities to invest money) shall come into force on 8th September 2009.

EXPLANATORY NOTE

(This note is not part of the Order)

Article 2 of this Order appoints a day for the coming into force of section 40 of the Local Government in Scotland Act 2003 (“the Act”).

Section 40 provides that the Scottish Ministers may make Regulations, specifying the investments which local authorities may make and providing for guidance to regulate the investment activity.

The provisions of the Act remaining to be commenced after the making of this Order are sections 8 (partially), 9 and 11.

NOTE AS TO EARLIER COMMENCEMENT ORDERS

The Act received Royal Assent on 11th February 2003. Sections 42(1), 42(2), 50 and 62 came into force on Royal Assent. The following provisions of the Act have been brought into force by Commencement Orders made before the date of this Order.
