The Scottish Ministers make the following Order in exercise of the powers conferred on them by section 2(2) of the Public Records (Scotland) Act 2011(1) and all other powers enabling them to do so.
In accordance with section 2(8) of that Act, a draft of this Order has been laid before and approved by resolution of the Scottish Parliament(2).
1. This Order may be cited as the Public Records (Scotland) Act 2011 (Authorities) Amendment Order 2015 and comes into force on the day after the day on which it is made.
2. In the schedule to the Public Records (Scotland) Act 2011 (authorities to which Part 1 of that Act applies)—
(a)under the heading “Others”, in the appropriate place according to alphabetical order, add the following entries—
“Criminal Courts Rules Council”;
“Panel appointed under regulation 90C of the Council Tax Reduction (Scotland) Regulations 2012(3)”;
“Scottish Civil Justice Council”;
“Scottish Fire and Rescue Service”;
“Scottish Sentencing Council”; and
“TS Prestwick Holdco Ltd (registered number SC462050)”.
(b)remove the following entries—
“Children’s Panel”;
“Learning and Teaching Scotland”; and
“Scottish Crime and Drug Enforcement Agency”.
(c)For the entry—
(i)“Her Majesty’s Chief Inspector of Constabulary and Her Majesty’s Inspectors of Constabulary (appointed under section 33 of the Police (Scotland) Act 1967 (c.77))” substitute “Her Majesty’s Chief Inspector of Constabulary and Her Majesty’s Inspectors of Constabulary (appointed under section 71 of the Police and Fire Reform (Scotland) Act 2012 (asp 8))”;
(ii)“Scottish Court Service” substitute “Scottish Courts and Tribunals Service”; and
(iii)“Chief constables of police forces in Scotland” substitute “Chief constable of the Police Service of Scotland”.

This Order amends the schedule to the Public Records (Scotland) Act 2011 (“the Act”) which lists the bodies, office-holders and other persons that are subject to Part 1 of the Act. Part 1 of the Act makes provision for records management plans.
Section 2(8) has been modified by paragraph 5(2) of schedule 3 to the Interpretation and Legislative Reform (Scotland) Act 2010.
S.S.I. 2012/303. Regulation 90C was added by S.S.I. 2013/218 and amended by S.S.I. 2015/46.
