The Secretary of State for Social Services, in exercise of powers conferred on him by sections 35(1), (4), 36(1) and 126(4) of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the National Health Service (General Dental Services) Amendment (No. 2) Regulations 1987 and shall come into force on 1st October 1987.

Amendment of regulations

2.—(1) The National Health Service (General Dental Services) Regulations 1973(2) shall be amended in accordance with the following provisions of this regulation.

(2) In regulation 26D (Amount and time of payments in consequence of suspension)—

(a)in paragraph (1)(a)(i) for the amount “£1808” there shall be substituted the amount “£1935”;

(b)in paragraph (1)(a)(ii) for the amount “£904” there shall be substituted the amount “£967”;

(c)in paragraph (1)(b)(i) for the amount “£904” there shall be substituted the amount “£967”;

(d)in paragraph (1)(b)(ii) for the amount “£1808” there shall be substituted the amount “£1935” and

(e)in paragraph (2) for the amount “£99,415” in both places where it occurs there shall be substituted the amount “£107,103”.

(3) In Part I of Schedule 1 (terms of service for dentists) in paragraph 10A (preventive treatment) after the words “topical fluoride preparations” there shall be inserted the words “or fissure sealants”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the National Health Service (General Dental Services) Regulations 1973, which concern arrangements under which dentists provide general dental services under the National Health Service in England and Wales.

Regulation 2(2) of these Regulations increases the amounts of, and amounts used in calculating, payments to dentists during periods of suspension of their registration under the Dentists Act 1984 by an interim suspension order or a direction or order of the Health Committee.

Regulation 2(3) of these Regulations enables dentists to provide as preventive treatment the application of fissure sealants to persons under 16.

For amendments to section 35(3), see paragraph 8 of Schedule 5 to the Dentists Act 1984 (c. 24). Section 36 was amended by the Health and Social Security Act 1984 (c. 48) Schedule 3, paragraph 5.
