CHANGES IN LOCAL GOVERNMENT AREAS

The Warwickshire and West Midlands (County and District Boundaries) Order 1993

The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 1972(1)and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect, with modifications, to proposals submitted to him under sections 47, 48(1) and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:

Citation and commencement

1.—(1) This Order may be cited as the Warwickshire and West Midlands (County and District Boundaries) Order 1993.

(2) This Order shall come into force on 1st December 1993 for any purpose set out in regulation 4(1) of the Local Government Area Changes Regulations 1976(2).

(3) For all other purposes, this Order shall come into force on 1st April 1994.

Interpretation

2.  In this Order–

  • “district” includes a metropolitan borough and a city;

  • “electoral division” means an electoral division of the county of Warwickshire;

  • “the map” means one of the 14 maps prepared by the Department of the Environment, marked “Maps of the Warwickshire and West Midlands (County and District Boundaries) Order 1993”, duly numbered for reference, and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976;

any reference to an area as unparished is a reference to that area not forming part of any parish;

“ward” means a ward of the district from or to which an area is transferred;

“Warwickshire” means the county of Warwickshire, and any reference to Nuneaton and Bedworth, to Rugby, to Warwick or to North Warwickshire is a reference to the Warwickshire district of that name; and “West Midlands” means the metropolitan county of West Midlands, and any reference to Coventry or to Solihull is a reference to the West Midlands district of that name.

Transfers between Warwickshire (Rugby) and West Midlands (Coventry)

3.—(1) Each area which is marked as shown in column 1 of the following Table on map 1 shall be transferred from Warwickshire, from Rugby and from the parish named in column 2 to Coventry, to the ward named in column 3, and to the Coventry District petty sessional division and the Coventry coroner’s district, becoming unparished.

4.—(1) Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 shall be transferred from the district and the parish (or, if unparished, from the ward) named in column 3 to West Midlands, to Coventry, to the ward (and the parish, if any) named in column 4, and to the Coventry petty sessional division and the Coventry coroner’s district.

Transfers from West Midlands (Solihull) to Warwickshire (Warwick)

5.—(1) The parts of the parish of Berkswell marked A on map 4 and A and B on map 12 shall be transferred from West Midlands, and from Solihull to Warwickshire, to Warwick, and to the Mid-Warwickshire petty sessional division and the Warwickshire coroner’s district. The area marked A on map 4 shall additionally be transferred to the parish of Stoneleigh, the Stoneleigh ward and the Kenilworth Stoneleigh electoral division, and the areas marked A and B on map 12 to the parish of Kenilworth, the Abbey ward, and the Kenilworth Abbey electoral division.

Transfer within Warwickshire from Warwick to Rugby

6.  The area marked A on map 10 shall be transferred from Warwick and from the parish of Baginton to Rugby, to the parish of Ryton-on-Dunsmore, to the Ryton-onDunsmore ward, to the Earl Craven electoral division, and to the Rugby petty sessional division.

Transfers within West Midlands between Coventry and Solihull

7.  Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 shall be transferred from the district and parish (or, if unparished, from the ward) named in column 3 to the district, parish (if any), ward, petty sessional division and coroner’s district named in column 4.

6.—(1) In this article, “provision” means a provision of a development plan (as defined in section 336(1) of the Town and Country Planning Act 1990(3)).

(2) Any provision applying to an area transferred by this Order shall continue to apply to that area, notwithstanding the transfer, until replaced by a provision which so applies, and which is expressed to supersede the preserved provision.

Explanatory Note

(This note is not part of the Order)

This Order makes changes in the boundary between the county of Warwickshire and the metropolitan county of West Midlands, affecting the Warwickshire districts of Rugby, Nuneaton and Bedworth, North Warwickshire, and Warwick, and the West Midlands districts of Coventry and Solihull. It also transfers areas between districts within those counties, affecting the boundary between Rugby and Warwick, and between Coventry and Solihull. Consequential changes to local government electoral areas, petty sessional divisions and coroners' districts are made.

The map and table forming part of this Note are a general guide only to the areas affected. The table gives in approximate terms the total amount of land and the population affected by each set of transfers. The map[s] described in article 2 should be inspected for full details of the transfers. Any person may inspect the maps at any reasonable time at the offices of each city, borough, metropolitan borough or district whose area is affected, and additionally at the offices of the Secretary of State for the Environment located in 2, Marsham Street, London SW1P 3EB.

The Local Government Area Changes Regulations 1976 contain general provisions regarding the effect of orders such as this one.

Transfers between Warwickshire (Rugby) and West Midlands (Coventry) – article 3 Area: 210 hectares Population: 25

General description of changes

Transfers and realignment of boundary along the A46 road in the following locations–

(i)

Ansty, near M6 motorway;

(ii)

Binley Woods, starting near Coombe Pool and running south to the vicinity of Piles Coppice;

(iii)

Tollbar End/Black Spinney/Willenhall Wood;

(iv)

High Bridge;

(v)

Hungerley Hall Farm.

Transfers between Warwickshire (Nuneaton and Bedworth, North Warwickshire, Warwick) and West Midlands (Coventry) – article 4 Area: 20 hectares Population: 10

Realignment of Coventry/Nuneaton and Bedworth boundary–

(i)

along Bennett’s Road in vicinity of The Crescent and Keresley Newland County Junior School;

(ii)

near the Mineral Railway/Houldsworth Crescent/Burrages Lane/A444 road/Rowleys Green Lane;

(iii)

in area west of Rowleys Green Lane near Woodshires Green/River Sowe/Industrial Estate;

(iv)

by transfer to Coventry of area at Woodshires Green, including part of hotel and of warehouse near Wilson’s Lane, south west of the M6 motorway.

Realignment of North Warwickshire/Coventry boundary along Wall Hill Road, from Watery Lane to a point south of Stone House Farm.

Changes in the Warwick/Coventry boundary as follows–

(i)

Transfer to Coventry of Finham Junior School and Finham Park Comprehensive School.

(ii)

Realignments in the vicinity of the A46 road at Baginton Bridge.

Transfers from West Midlands (Solihull) to Warwickshire (Warwick) – article 5 Area: 20 hectares Population: 220

Transfer of area west of Cromwell Lane, including Arnold Farm and part of Hodgett’s Lane.

Transfer of areas near Hob Lane, including Moat Farm and Burton Green Farm.

Transfer within Warwickshire from Warwick to Rugby – article 6 Area: 1 hectare Population: Nil
Minor realignment along River Avon near Coventry Airport.
Transfers within West Midlands between Coventry and Solihull – article 7 Area: 10 hectares Population: 390

Transfer to Solihull of area south of Birmingham Road, including Bonneville Close, James Dawson Drive, and related development.

Transfer to Solihull of area north west of Hollyberry Farm. Transfer to Coventry of sports ground at Berkswell.

Realignment of boundary in Tanner’s Lane/Duggins Lane area.
