The Secretary of State for Social Security, in exercise of the powers conferred by sections 30E(1), 122(1) and 175(1) to (4) of the Social Security Contributions and Benefits Act 1992(1), and of all other powers enabling him in that behalf, and after agreement by the Social Security Advisory Committee that proposals in respect of these regulations should not be referred to it(2), hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Social Security Benefits Up-rating and Miscellaneous Increases Regulations 2000 and shall come into force on 10th April 2000.

Amendment of the Social Security (Incapacity Benefit) Regulations 1994

2.  In regulation 8 of the Social Security (Incapacity Benefit) Regulations 1994(3) (limit of earnings from councillor’s allowance) for the sum of “£49.50” substitute the sum of “£58.50”.

Revocation

3.  Regulation 5 of the Social Security Benefits Up-rating Regulations 1999(4) is hereby revoked.

Explanatory Note

(This note is not part of the Regulations)

This instrument contains a provision to increase from £49.50 to £58.50 the limit of earnings from a councillor’s allowance in relation to incapacity benefit. The increase is partly consequential on an order under section 150 of the Social Security Administration Act 1992 (up-rating of benefits), and also aligns the councillors' allowance limit with the therapeutic earnings limit in incapacity benefits. As a consequence of this increase, regulation 5 of the Social Security Benefits Up-rating Regulations 1999 (S.I. 1999/858) is revoked.

The increase is also relevant for the purposes of severe disablement allowance by virtue of regulation 8A of the Social Security (Severe Disablement Allowance) Regulations 1984 (S.I. 1984/1303, as amended by regulation 2(6) of S.I. 1994/2947).

These Regulations do not impose any costs on business.
