The Secretary of State, in exercise of his powers under sections 15(1) and 94(1) of the Weights and Measures Act 1985(1), makes the following Regulations:
1. These Regulations may be cited as the Weights and Measures (Metrication Amendments) Regulations 2009 and come into force on 1st January 2010.
2. In these Regulations, “the 2001 Regulations” means the Weighing Equipment (Beltweighers) Regulations 2001(2).
3.—(1) In each of the provisions listed in paragraph (2), omit “up to and including 31st December 2009”.
(2) Those provisions are—
(a)regulations 11A and 16A of the Measuring Equipment (Liquid Fuel delivered from Road Tankers) Regulations 1983(3);
(b)regulation 7A of the Measuring Equipment (Intoxicating Liquor) Regulations 1983(4);
(c)regulation 12A of the Weighing Equipment (Filling and Discontinuous Totalising Automatic Weighing Machines) Regulations 1986(5);
(d)regulation 17A of the Measuring Equipment (Measures of Length) Regulations 1986(6);
(e)regulation 10(6) of the Capacity Serving Measures (Intoxicating Liquor) Regulations 1988(7);
(f)regulation 16(7)(b) of the Measuring Equipment (Capacity Measures and Testing Equipment) Regulations 1995(8);
(g)regulation 8(4) of the Measuring Equipment (Liquid Fuel and Lubricants) Regulations 1995(9);
(h)regulation 6A of the Weighing Equipment (Automatic Gravimetric Filling Instruments) Regulations 2000(10);
(i)regulation 18 of the Weighing Equipment (Non-automatic Weighing Machines) Regulations 2000(11);
(j)regulation 8(2) of the 2001 Regulations; and
(k)regulation 7 of the Weighing Equipment (Automatic Catchweighing Instruments) Regulations 2003(12).
4. Regulations 2 and 3(1) of the Weights and Measures (Metrication Amendments) Regulations 2001(13) are revoked.
5. Regulation 12A of the Weighing Equipment (Beltweighers) Regulations 1983(14), so far as remaining in force by virtue of regulation 1(3) of the 2001 Regulations, is to be read as if the words “up to and including 31st December 2009” were omitted.

These Regulations implement in part the amendments made by Directive 2009/3/EC of the European Parliament and the Council (OJ L114, 7.5.2009, p 10) to Council Directive 80/181/EEC (OJ L39, 15.2.1980, p 40), which relates to the use of units of measurement.
Regulation 3 removes the time limit on the use of supplementary indications of quantity expressed in imperial units of measurement (31 December 2009) which is provided for in the regulations there listed. The use of supplementary indications is, therefore, permitted indefinitely.
In consequence of provision in regulation 3, regulation 4 partially revokes the Weights and Measures (Metrication Amendments) Regulations 2001, which inserted the 31 December 2009 time limit in question.
Regulation 5 modifies the Weighing Equipment (Beltweighers) Regulations 1983 so that, where they continue to apply to beltweighers passed as fit for use for trade prior to 28th September 2001, they are read as if the 31 December 2009 time limit were omitted.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
