The Secretary of State for Business, Innovation and Skills makes the following Regulations in exercise of the powers conferred by sections 24(6) and 47 of the Higher Education Act 2004(1).

In accordance with section 26(2)(a)(i) and (b)(i) of that Act, the Secretary of State is satisfied that the increases to the basic and higher amounts are no greater than are required to maintain the value of those amounts in real terms.

In accordance with section 26(3) of that Act, the Secretary of State has had regard to the index of prices specified in regulations made under that subsection(2).

Citation and commencement

1.  These Regulations may be cited as the Student Fees (Amounts) (England) (Amendment) Regulations 2011 and come into force on 1st August 2011.

Amendment of the Student Fees (Amounts) (England) Regulations 2004

2.—(1) The Student Fees (Amounts) (England) Regulations 2004(3) are amended in accordance with paragraphs (2) to (4).

(2) In regulation 3 omit the definition of “academic year”;

(3) In regulation 4 for “£1310” substitute “£1345” and for “£3290” substitute “£3375”;

(4) In regulation 5 for “£650” substitute “£665” and for “£1640” substitute “£1680”.

Revocation of the Student Fees (Amounts) (England) (Amendment) Regulations 2009

3.  The Student Fees (Amounts) (England) (Amendment) Regulations 2009(4) are revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Student Fees (Amounts) (England) Regulations 2004 (“the 2004 Regulations”) by increasing the basic and higher amounts prescribed in the 2004 Regulations. The amendments come into force on 1st August 2011.

The 2004 Regulations prescribe the basic and higher amounts which higher education institutions in England may charge by way of tuition fees. Regulation 4 of the 2004 Regulations sets out the basic and higher amounts which ordinarily apply. Regulation 5 sets out the lower basic and higher amounts which apply in respect of an academic year of specified courses.

Regulation 2(2) removes the definition of “academic year”.

The Student Fees (Amounts) (England) (Amendment) Regulations 2009 which came into force on 1st September 2010 are revoked by these Regulations.

S.I. 2004/1932, amended by S.I. 2009/3113 which came into force on 1st September 2010. Previous amending regulations have been revoked.
