The National Health Service (Direct Payments) Regulations 2013

The Secretary of State for Health makes the following Regulations in exercise of the powers conferred by sections 12A(4), 12B(1) to (4), 75, and 272(7) and (8) of the National Health Service Act 2006(1).

2006 c. 41. Sections 12A to 12D of the National Health Service Act 2006 (“the 2006 Act”) were inserted by section 11 of the Health Act 2009 (c. 21) (“the 2009 Act”). Sections 12A and 12B have been amended by section 55(1) of, and paragraphs 10 and 11 of Part 1 of Schedule 4 to, the Health and Social Care Act 2012 (c.7) (“the 2012 Act”). Sections 12A(6) and 12C(1) to (4) have been repealed by the National Health Service (Direct Payments) (Repeal of Pilot Schemes Limitation) Order 2013 (S.I. 2013/1563). See section 275 of the 2006 Act for the definitions of “prescribed” and “regulations”. By virtue of section 271(1) of the 2006 Act, the powers exercised in making these Regulations are exercisable by the Secretary of State only in relation to England.
